Property dispute in army camp: Supreme Court stays order to imprison soldiers in civil jails

The Supreme Court on Thursday stayed a decision of a court in Telangana which had ordered Major General of Indian Army (GOC) and Defence Estate Officer to be imprisoned for two months in civil prison.

The Telangana court had ordered imprisonment of the Army Officer and DO while dealing with execution proceedings in a land dispute.

The Telangana High Court had refused to grant a stay on that order prompting the Central government to approach the Supreme Court.

Solicitor-General Tushar Mehta mentioned this matter before a bench of CJI SA Bobde and Justices AS Bopanna and V Ramasubramanian and sought an urgent stay.

“We stay the entire order passed in execution proceedings,” the top court ordered.

The genesis of the case when the Central government had moved a court in Telangana laying claim to land alleged to have been encroached by one Veera Raghav Reddy.

It was alleged that the defendant had encroached upon government land which was under military use and occupation and used for parade and training ground and that encroachment was to the extent of 9 acre which was known as the paigah land.

The defendant had stated that he and his ancestors had been in continuous, open and adverse possession for over 160 years and the rights alleged to have acquired by the other party like cantonment has become completely extinguished by the lapse of time.

The suit was dismissed by Third Additional Judge, City Civil Court, Secunderabad. This was challenged before the High Court. When this appeal was pending the defendant sold 5 acres and 34 guntas of the land under dispute.

A counter petition was filed by the Respondents which was allowed by the trial court and was decreed in favour of the legal heirs of the original defendant.

Through that order, the Central government was restrained from interfering with the peaceful possession of the land by the original defendent’s heirs.

In execution proceedings in relation to that order, the trial court ordered on January 27, 2021, that the Major General of Indian Army (GOC) and Defence Estate Officer be sent to civil prison for a period of two months each of their willful disobedience and violation of the decree of permanent injunction passed by High Court in 2017.

Aggrieved, the Government moved the High Court by way of a Civil Revision Petition seeking a stay. But despite the fact a major general of the Indian Army was ordered to go to civil prison, High Court still refused to interfere in the matter and adjourned it without passing any orders.

പഴയ നിയമ കാലത്ത് യഹൂദരുടെ ഇടയിൽ, അവരുടെ ജീവിതത്തിലെ വളരെ ക്ലേശകരമായ സ്ഥിതി വിശേഷങ്ങളെ കോട്ട, മല എന്ന പ്രയോഗമുപയോഗിച്ചാണ് പലപ്പോഴും വിശേഷിപ്പിച്ചിരുന്നത്. ജീവിതത്തിൽ പല പ്രതിസന്ധികളും നമ്മുടെ മുൻപിൽ കോട്ടപോലെ ഉറച്ച് നിൽക്കുവായിരിക്കും എന്നാൽ ജീവിതത്തിൽ ഉള്ള ഏത് പ്രതിസന്ധികളെയും ദൈവത്തിൻറെ ശക്തിയാൽ ചാടി കടക്കാമെന്നാണ് ദൈവത്തിൻറെ വചനം പ്രതിപാദിക്കുന്നത്. പ്രതിസന്ധി ആകുന്ന കോട്ട ചാടി കടക്കുവാൻ നമുക്ക് ആദ്യം വേണ്ടത് ദൈവത്തിൽ അടിയുറച്ച വിശ്വാസം ആണ്. നാം വലുതെന്നു കരുതുന്ന പ്രശ്നങ്ങൾ ആകുന്ന കോട്ടകളോട് നമുക്ക് പറയുവാൻ സാധിക്കണം നമ്മുടെ ദൈവം അവയെക്കാൾ വലിയവനാണെന്ന്. അപ്പോൾ നമ്മൾ കോട്ടകളെ ചാടി കടക്കാൻ പറ്റുന്ന തക്ക വിശ്വാസത്തിനു ഉടമകളായിത്തീരും.

നമ്മുടെ ജീവിതപ്രശ്നങ്ങളെയെല്ലാം വലിയ കോട്ടകളായി കണ്ട്, അവയെക്കുറിച്ച് ദൈവസന്നിധിയിൽ ആവലാതി പറയുന്ന ഒരു രീതിയിലേക്ക് നമ്മുടെ പ്രാർത്ഥന ചെന്നെത്താറുണ്ട്. നമ്മുടെ പരിമിതമായ കാഴ്ചപ്പാടുകളുടെ വെളിച്ചത്തിൽ നമ്മുടെ പ്രശ്നങ്ങളെ കാണുമ്പോഴാണ് അവയെല്ലാം വലിയ പ്രതിബന്ധങ്ങളായി നമുക്ക് തോന്നുന്നത്. ഈ തോന്നലുകളിൽ നിന്നാണ് ഭയവും നിരാശയുമൊക്കെ ഉടലെടുക്കുന്നത്. എന്നാൽ ഈ പ്രശ്നങ്ങളിൽ നിന്നു കണ്ണെടുത്ത്‌, വിശ്വാസ ദൃഷ്ടികളോടെ ദൈവത്തെ തിരയുന്ന ഒരു വ്യക്തിക്ക് ദൈവം തന്നെ വെളിപ്പെടുത്തിത്തരുന്ന ഒരു കാര്യമാണ്, ദൈവത്തിന്റെ അപരിമിതമായ ശക്തിക്കു മുൻപിൽ നമ്മുടെ ജീവിതത്തിലെ പ്രശ്നങ്ങൾ എത്രയോ നിസ്സാരങ്ങളാണെന്നുള്ളത്.

ദൈവത്തിൽ മാത്രം ആശ്രയിക്കുന്നവനുവേണ്ടി യുദ്ധം ചെയ്യുന്നത് ദൈവമാണ്. സാധ്യതയുടെ വാതിലുകൾ എല്ലാം അടയുമ്പോളും, പ്രതീക്ഷിക്കാൻ വകയൊന്നും ഇല്ലാതിരിക്കുമ്പോഴും ഹൃദയ ശുദ്ധിയോടെ ദൈവത്തിൽ മാത്രം ആശ്രയിക്കുക, അപ്പോൾ നമ്മുടെ വേദനകരമായ സാഹചര്യങ്ങളിൽ ദൈവം നമുക്ക് ശക്തി നൽകും. ചിലപ്പോൾ കഷ്ടത അനുഭവിക്കുന്നത് ദൈവത്തിന്റെ നന്മയുടെ ഭാഗമായിട്ടാണ്. പുതിയ നിയമ കാലഘട്ടത്തിൽ കർത്താവ് നൽകുന്ന ശക്തി പരിശുദ്ധാൽമാവിലൂടെയും വചനത്തിലൂടെയും ആണ്. പരിശുദ്ധാത്മാവ് ഏതൊരു തലത്തിലുള്ള പ്രതികൂലങ്ങളെയും അതിജീവിക്കാൻ സഹായിക്കുന്ന നമ്മുടെ സഹായകനാണ്.

ദൈവമായ കര്‍ത്താവിനെ അന്വേഷിക്കാന്‍ ഹൃദയവും മനസും ഒരുക്കുക. ബാഹ്യനേത്രങ്ങൾ ഉപയോഗിച്ചല്ല ആരും ദൈവത്തെ അന്വേഷിക്കുന്നത്. ഹൃദയം കൊണ്ടാണ് നമ്മൾ ദൈവത്തെ അന്വേഷിക്കുന്നത്, ഹൃദയം കൊണ്ട് ദൈവത്തെ അന്വേഷിക്കണമെങ്കിൽ നാം ഹൃദയത്തെ വിശുദ്ധീകരിക്കണം. ഹൃദയം എന്ന ശാരീരിക അവയവത്തെ പദം കൊണ്ട് വിശേഷിപ്പിക്കാമെങ്കിലും, പൂർണ്ണമായ അർത്ഥത്തിൽ ഹൃദയം എന്ന വാക്ക് അർത്ഥമാക്കുന്നത്‌ നമ്മുടെ ചിന്തകളുടെയും ആഗ്രഹങ്ങളുടെയും ലക്ഷ്യങ്ങളുടെയും തീരുമാനങ്ങളുടെയും സ്വഭാവങ്ങളുടെയും ഉറവിടം എന്നാണ്.

ഒരു മനുഷ്യന്റെ വിചാരങ്ങളും വികാരങ്ങളും തീരുമാനങ്ങളും വളരെ തീഷ്ണമായ ഒരു ശുദ്ധീകരണ പ്രക്രിയയിലൂടെ കടന്നുപോയതിനു ശേഷമാണ് അയാൾ ഹൃദയത്തിൽ ശുദ്ധിയുള്ളവനായി മാറുന്നത്. ഞാൻ മുന്തിരിവള്ളിയും നിങ്ങൾ ശാഖകളുമാണെന്നു പറഞ്ഞ ഈശോ, അതോടൊപ്പം തന്നെ, ഫലം തരുന്നതിനെ കൂടുതൽ കായ്ക്കാനായി പിതാവായ ദൈവം വെട്ടിയൊരുക്കുന്നു എന്നും നമ്മോടു പറഞ്ഞിട്ടുണ്ട് (യോഹന്നാൻ 15:1-17). നമ്മുടെ ഹൃദയത്തിൽ വേരുപാകിയിരിക്കുന്ന അനാവശ്യമായുള്ളവ എല്ലാം അഗ്നിയിൽ ദഹിപ്പിച്ചും വെട്ടിയോരുക്കിയും, നമ്മുടെ എല്ലാ പ്രവർത്തികളുടെയും വിചാരങ്ങളുടെയും തീരുമാനങ്ങളുടെയും ആത്യന്തിക ലക്‌ഷ്യം ദൈവം ആയി മാറുമ്പോഴാണ് നമ്മൾ ഹൃദയശുദ്ധി ഉള്ളവരാകുന്നത്.

നമ്മുടെ ജീവിതത്തിന്റെ എല്ലാ അവസ്ഥകളിലും ദൈവമഹത്വത്തിനായി മനസും ഹൃദയവും ദൈവത്തിനു മുൻപാകെ സമർപ്പിക്കുവാൻ തയ്യാറാകുക. അടുത്തതായി നാം ഹൃദയത്തെയും മനസിനെയും ഒരുക്കേണ്ടത് പ്രാർത്ഥനയോടെയും ഉപവാസത്തോട് കൂടിയും ആയിരിക്കണം. നാം ഒരോരുത്തർക്കും ദൈവമായ കര്‍ത്താവിനെ അന്വേഷിക്കാന്‍ ഹൃദയവും മനസും ഒരുക്കുവാനുള്ള ദൈവകൃപയ്ക്കായി പ്രാർത്ഥിക്കാം.

3 promises Jesus offered us on Palm Sunday

If you were asked to describe our world in one word, would you choose the word “peaceful”? I’m guessing there are a lot of other words that come to mind before peaceful. Your list may include words like chaotic, broken, unstable, frightening, or disintegrating.

As a nation, we’ve lost confidence in our government, medical institutions, and scientific exploration. And many have lost confidence in religion, with church attendance at an all-time low.

Right now, the world is anything but peaceful.

But we all desire and need peace. So many people look for peace in superficial things, including drugs, alcohol, entertainment, and money. And yet, they still feel empty.

Truthfully, we’ve been looking for peace in all the wrong places and the world cannot offer true, lasting peace. We need a peace that isn’t of this world.

Other-worldly peace is just what Jesus offers us. On Palm Sunday, a week before He was to go to the cross, suffer and die, Jesus took His disciples aside and gave them an amazing promise, saying, “Peace I leave with you; my peace I give you.”

This is a remarkable promise.

Think about what Jesus was going through when He made this promise. He had spent the last three years of his life hounded by the haters and suffocated by persecutors and oppressors. There was constant pressure on Jesus’ life.

Despite all this, Jesus had peace. It is this peace that He invited His disciples — and by extension us — to share in.

Today, Christ offers the world three kinds of peace:

1. Peace with God

Christ offers peace with God. In Romans 5:1-10, Paul tells us that all human beings begin as enemies with God and that it is only through faith in Christ that we can have peace with God. In fact, it was Jesus’ death and Resurrection that made this peace possible.

Jesus knew this was the case. He knew His death was the only way to reconcile a sinful people with a righteous God. This is what Christ came to do and it is why, hanging on the cross a week after giving His disciples His peace, He could proclaim, “It is finished!” The war is over. Peace between God and humanity is now possible.

2. The peace of God

Christ also offers his followers the peace of God. Earlier in John 14, Jesus gives an interesting instruction to His disciples: “Do not let your hearts be troubled.” This is a daunting command and I imagine all the disciples wanted to do was ask, “How?”

We turn to Isaiah 26:3 for the answer: “You will keep in perfect peace those whose minds are steadfast, because they trust in you.” Jesus is saying that our minds are crucial to experiencing God’s peace. With our minds fixed on Him, we can be at peace in this chaotic and anxious world.

Paul picks up this theme in Philippians 4:8-9. He tells the Church, “Finally, brothers and sisters, whatever is true, whatever is noble, whatever is right, whatever is pure, whatever is lovely, whatever is admirable — if anything is excellent or praiseworthy — think about such things.”

The result? “The God of peace will be with you.”

3. The peace God will bring when Christ returns

Finally, we’re offered the peace God will bring when Christ comes back to dwell among us.

It’s no coincidence that one of Jesus’ titles is “Prince of Peace.” We are promised that the world won’t have true, lasting peace until Christ comes again. But when he does, Isaiah 2:4 tells us strange things will happen: “The wolf will live with the lamb, the leopard will lie down with the goat, the calf and the lion and the yearling together; and a little child will lead them.”

What is Isaiah saying?

He is saying there will be peace that our minds can’t yet even fathom. Deep, lasting, transcendent peace. A peace this world can’t explain or recreate.

But it’s a peace that makes perfect sense if you know Jesus.

At the very end of John 16, the very end of Palm Sunday, Jesus gives His disciples a powerful promise. Today, over 2,000 years later, Jesus extends to us the same transcendent promise of peace saying, “I have told you these things, so that in me you may have peace. In this world, you will have trouble. But take heart. I have overcome the world.”
