സ്കൂള് അധ്യാപകരായ വൈദികരും കന്യാസ്ത്രീകളും ആദായ നികുതി ഒടുക്കണമെന്ന് സുപ്രീം കോടതി
സ്കൂള് അധ്യാപകരായ കന്യാസ്ത്രീകളുടെയും വൈദികരുടെയും ശമ്പളത്തില് നിന്ന് ആദായനികുതി ഈടാക്കണമെന്ന് സുപ്രീം കോടതി. കഴിഞ്ഞ വർഷത്തെ വിധിയിൽ പുനപരിശോധന ആവശ്യപ്പെട്ട ഹർജി തള്ളികൊണ്ടാണ് കോടതിയുടെ വിധി. കഴിഞ്ഞ വര്ഷം നവംബറിലാണ് ചീഫ് ജസ്റ്റിസ് ഡി വൈ ചന്ദ്രചൂഡ് അധ്യക്ഷനായ മൂന്നംഗ ബെഞ്ച് ശമ്പളത്തില് നിന്ന് ടിഡിഎസ് ഈടാക്കാമെന്ന് വിധിച്ചത്. ഇത് ശരിവച്ചു കൊണ്ടാണ് ചീഫ് ജസ്റ്റിസ് സഞ്ജീവ് ഖന്ന അധ്യക്ഷനായ ബെഞ്ചിൻ്റെ പുതിയ വിധി വന്നിരിക്കുന്നത്. സര്ക്കാര് – എയ്ഡഡ് സ്കൂളുകളില് അധ്യാപകരായി ജോലി ചെയ്യുന്ന കന്യാസ്ത്രീകള്ക്കും വൈദികര്ക്കും നല്കുന്ന ശമ്പളത്തിന് ആദായനികുതി ബാധകമാണെന്ന മദ്രാസ് ഹൈക്കോടതി ഡിവിഷന് ബെഞ്ചിന്റെ ഉത്തരവ് കഴിഞ്ഞ വര്ഷം സുപ്രീം കോടതി ശരിവെച്ചിരുന്നു.
ശമ്പളം വാങ്ങുന്ന വ്യക്തികള് ആദായ നികുതി നല്കാന് ബാധ്യസ്ഥരാണ്. മതപരമായ കാരണങ്ങളുടെ പേരില് ഇളവ് അനുവദിക്കാൻ കഴിയില്ല. വൈദികരും കന്യാസ്ത്രീകളും ശമ്പളം വ്യക്തിപരമായ ആവശ്യങ്ങള്ക്കല്ല, മറിച്ച് സമൂഹ നന്മയ്ക്കായാണ് വിനിയോഗിക്കുന്നത് എന്ന ഹര്ജിക്കാരുടെ വാദം കോടതി അംഗീകരിച്ചില്ല. അധ്യാപകരായ കന്യാസ്ത്രീകളെയും വൈദികരെയും ആദായനികുതി അടയ്ക്കുന്നതില് നിന്ന് ഒഴിവാക്കണമെന്ന് ആവശ്യപ്പെട്ട് കേരളത്തില് നിന്നടക്കം വന്ന 93 ഹര്ജികള് തള്ളിക്കൊണ്ടായിരുന്നു കഴിഞ്ഞ വര്ഷത്തെ സുപ്രിംകോടതിയുടെ സുപ്രധാന വിധി.
വൈദികരോ കന്യാസ്ത്രീകളോ ആരായാലും ശമ്പളം വാങ്ങുന്ന ഏതൊരു വ്യക്തിയും നികുതി നല്കണമെന്ന സുപ്രീം കോടതി വിധി ആവര്ത്തിച്ചു കൊണ്ടാണ് റിവ്യൂ പെറ്റീഷന് തള്ളിക്കൊണ്ട് മൂന്നംഗ ബെഞ്ച് വ്യക്തമാക്കിയത്. നിയമം എല്ലാവര്ക്കും ഒരുപോലെയാണെന്നും കോടതി ഓര്മ്മിപ്പിച്ചു.

The Supreme Court of India on Thursday dismissed review petitions challenging its previous order that upheld the applicability of Tax Deducted at Source (TDS) on salaries paid to Christian nuns and priests working as teachers in government-aided institutions. A bench comprising Chief Justice Sanjiv Khanna, Justice JB Pardiwala, and Justice Manoj Misra delivered the ruling, citing no valid grounds for review. The petitions were filed by Catholic religious institutions affected by the decision.
The bench stated: “After reviewing the petitions and the enclosed documents, we find no valid reason to review the order dated 07.11.2024.” Accordingly, the Court dismissed the review petitions. The bench also noted that one of the review petitions it dismissed was marked as withdrawn. It also denied a request for oral hearings in open court.
In its earlier deliberations in November 2024, the Supreme Court—then led by Chief Justice DY Chandrachud—upheld the principle of uniform tax application. The bench asserted that all salaried individuals are subject to taxation, regardless of religious identity or post-salary disposition. CJI Chandrachud had remarked that employment income must be taxed at the source, even if the recipient donates it subsequently.
Senior Advocate Arvind Datar, representing some appellants, argued that nuns and priests effectively have no taxable income since they do not retain salaries for personal use and claimed a civil death under Canon Law.
“As per the definition of the Income Tax Act, an individual is a person who is capable of receiving money. Priests and nuns working in Church-run educational institutions are not. They are people who have virtually undergone civil death and are not capable of earning a taxable income,” Datar said. He further added that not every receipt is taxable, and for a receipt to be taxable, it should be in the form of an income, but presently, the nuns/priests were not retaining the salaries for their own use. He also referred to a CBDT circular that purportedly exempts clergy from TDS.
The Court, however, dismissed these arguments, reinforcing that the religious character of an individual does not alter statutory tax obligations.
This latest decision by the Supreme Court reaffirms its earlier endorsement of the Madras High Court’s ruling that income accrued to nuns and priests in their individual capacity is subject to TDS, regardless of their subsequent surrender of earnings to religious institutions. The High Court had overturned a single-judge bench ruling that exempted such salaries from TDS on the basis of the clergy’s vow of poverty and the canonical concept of ‘civil death’. The court emphasized that income earned individually cannot be exempt from tax merely because it is later surrendered to religious institutions. Citing the Kerala High Court’s precedent in Fr. Sabu P Thomas v. Union of India, the Division Bench ruled that the subsequent surrender of salaries does not constitute a legal diversion of income by overriding title at the source.

Indian court says Christian woman can file for divorce where she lives
Church leaders have welcomed a ruling by a provincial top court in southern India allowing a Christian woman to seek dissolution of her marriage in a family court where she currently resides after moving out of her matrimonial home.
The Kerala High Court’s Aug. 19 ruling came on an appeal filed by a Christian woman seeking legal separation from her husband due to domestic violence.
The woman, who resides at her parental home in Kerala state’s Wayanad district, had challenged a family court order directing her to file her application in Kasargod district, where her estranged husband and his family live.

The British-era Indian Divorce Act of 1869, which governs judicial separation and marriage dissolution, among other things, for Christians in India, makes it mandatory for women to approach a family court in the place where “the marriage was solemnized, or the husband and wife reside or last resided together.”
In her appeal to the High Court, the Christian woman argued that this restriction resulted “in serious prejudice to Christian women who intend to file for divorce.”
The woman had earlier challenged the family court order before a single bench of the Kerala High Court on the grounds that she was not in a position “to travel long distances, in protracted litigations in a hostile jurisdiction.”
She pointed out that women were allowed to approach family courts where they resided under the Hindu Marriage Act, 1955, as well as the Special Marriage Act, 1954, which enables marriages between individuals of any religion, caste, or nationality, but not under the law governing Christian marriages.
The single-judge bench, in a June 30 ruling, agreed with her contentions but refused to grant her relief, holding that amending the law was the only solution and leaving it to the Indian Parliament to decide.
The judge, however, directed that the order be sent to the federal government, recommending it to amend the 1869 law.
The High Court’s division bench of Justices A K Jayasankaran Nambiar and Preeta A K, whom she approached later, allowed her appeal.
It ruled that she could file her application before a family court “having jurisdiction over the place where she is currently residing, even if that place is different from where the marriage was solemnized or where the couple last lived together.”
Church leaders hailed this Aug. 19 ruling as a “landmark decision” based on “a wise interpretation of a contentious clause.”
Father Ebigin Arackal, secretary to the Commission for Canon Law of the Kerala Region Latin Catholic Bishops’ Council, said, “We are glad that the top court, through its wise interpretation of a contentious clause, has ended decades-old discrimination against Christian women.”
Aleykutty P T, a lawyer in Kerala’s Idukki district, said Christian women were often forced to travel to places where their husbands were based, which made them insecure and sometimes even posed a threat to their lives.
“Now with this order, they can obviously choose a place where it’s safer and they get support,” she told UCA News on Aug. 20.
Govind Yadav, a lawyer at the Supreme Court in New Delhi, said this order for Kerala can become a precedent for other states to follow.
“But as long as the federal government fails to amend the colonial-era law, this discrimination against Christian women will continue,” he added.
Christians make up 2.3 percent of India’s more than 1.4 billion people; about 80 percent of whom are Hindus.
