ക്രിസ്ത്യൻ ശ്മശാനങ്ങൾ വർദ്ധിപ്പിക്കാനുള്ള നിർദ്ദേശത്തിൽ മേഘാലയ ഹൈക്കോടതി റിപ്പോർട്ട് തേടി
ക്രിസ്ത്യൻ സമുദായത്തിലെ അംഗങ്ങൾക്കായി ശ്മശാനങ്ങളുടെ എണ്ണം വർദ്ധിപ്പിക്കുന്നതിനുള്ള എന്തെങ്കിലും നിർദ്ദേശമുണ്ടോ എന്ന് സൂചിപ്പിച്ച് റിപ്പോർട്ട് സമർപ്പിക്കാൻ മേഘാലയ ഹൈക്കോടതി വ്യാഴാഴ്ച സംസ്ഥാനത്തോട് നിർദ്ദേശിച്ചു.
ക്രിസ്ത്യൻ സമുദായത്തിലെ അംഗങ്ങൾക്കായി ശ്മശാനങ്ങളുടെ എണ്ണം വർദ്ധിപ്പിക്കുന്നതിനുള്ള എന്തെങ്കിലും നിർദ്ദേശം നിലവിലുണ്ടോ അല്ലെങ്കിൽ പരിഗണനയിലുണ്ടോ എന്ന് വ്യക്തമാക്കുന്ന ഒരു റിപ്പോർട്ട് സമർപ്പിക്കാൻ സംസ്ഥാനത്തോട് നിർദ്ദേശിച്ചിട്ടുണ്ടെന്ന് ചീഫ് ജസ്റ്റിസ് ഐ പി മുഖർജി, ജസ്റ്റിസ് ഡബ്ല്യു ഡിയെങ്ദോ എന്നിവരടങ്ങിയ ബെഞ്ച് പറഞ്ഞു.
സംസ്ഥാനത്തുടനീളമുള്ള ഖാസി, ജയന്തിയ സമുദായങ്ങളിൽപ്പെട്ടവരുടെയും ഹിന്ദു മതം സ്വീകരിക്കുന്നവരുടെയും ശവസംസ്കാരം സംബന്ധിച്ച് സമർപ്പിച്ച ഒരു പൊതുതാൽപര്യ ഹർജി പരിഗണിക്കവേ, ക്രിസ്ത്യൻ വിശ്വാസത്തിലെ വിവിധ വിഭാഗങ്ങൾ അവരുടെ മരിച്ചവരെ ശ്മശാനങ്ങളിൽ സംസ്കരിക്കുന്നതിൽ സമാനമായ ബുദ്ധിമുട്ടുകൾ നേരിടുന്നുണ്ടെന്ന വിവരം ജുഡീഷ്യൽ ശ്രദ്ധയിൽപ്പെടുത്തിയതിനെത്തുടർന്ന്, ക്രിസ്ത്യൻ സമൂഹത്തെയും ഉൾപ്പെടുത്തി അതിന്റെ വ്യാപ്തി വിപുലീകരിക്കാൻ ബെഞ്ച് തീരുമാനിച്ചു.
“ഒരു വിഭാഗത്തിന്റെ നിയന്ത്രണത്തിലുള്ള ഒരു സെമിത്തേരി മറ്റൊരു വിഭാഗത്തിൽപ്പെട്ട വ്യക്തികളുടെ മൃതദേഹങ്ങൾ അതേ സെമിത്തേരിയിൽ സംസ്കരിക്കാൻ അനുവദിക്കുന്നില്ല. ഇതിന്റെ ഫലമായി സംസ്ഥാനത്തിന്റെ വിവിധ പ്രദേശങ്ങളിൽ, മരിച്ചവരുടെ അന്ത്യകർമങ്ങൾ നിർവഹിക്കുന്നതിന് ദുഃഖിതരായ കുടുംബാംഗങ്ങൾക്ക് വളരെ ദൂരം സഞ്ചരിക്കേണ്ടിവരുന്നു. സെമിത്തേരി പങ്കിടുന്നതിനും ക്രിസ്ത്യൻ സമൂഹത്തിന് ശ്മശാനങ്ങളായി ഉപയോഗിക്കുന്നതിന് പുതിയ സ്ഥലങ്ങൾ അനുവദിക്കുന്നതിനും സമാനമായ ആവശ്യമുണ്ട്,” എന്ന് അതിൽ പറയുന്നു.
ക്രിസ്ത്യൻ സമൂഹം നേരിടുന്ന പ്രശ്നം പരിഹരിക്കുന്നതിനും റിപ്പോർട്ട് സമർപ്പിക്കുന്നതിനുമായി ബന്ധപ്പെട്ട ജില്ലാ മജിസ്ട്രേറ്റുമാരുമായും സമൂഹത്തിലെ അംഗങ്ങളുമായും കൂടിക്കാഴ്ച നടത്താൻ അമിക്കസ് ക്യൂറി എൻ സിങ്കോണിനോട് ബെഞ്ച് നിർദ്ദേശിച്ചിരുന്നു.
ഏപ്രിൽ 8 ന് പുറപ്പെടുവിച്ച മുൻ ഉത്തരവിൽ, സംസ്ഥാനത്തെ വിവിധ പ്രദേശങ്ങളിൽ പുതിയ ശ്മശാനങ്ങൾ നിർമ്മിക്കാനുള്ള സർക്കാരിന്റെ നിർദ്ദേശം ബെഞ്ച് ശ്രദ്ധിച്ചിരുന്നു, പക്ഷേ അതിന് സമയമെടുക്കും.
ഖാസി, ജയന്തിയ സമുദായങ്ങളിലെ അംഗങ്ങൾക്ക് യോഗങ്ങൾ നടത്തിയ ശേഷം, ശ്മശാനത്തിന്റെ പ്രത്യേക ഭാഗങ്ങൾ ഓരോ സമുദായത്തിനും അനുവദിച്ചുകൊണ്ട്, മരിച്ചവരെ ദഹിപ്പിക്കുന്നതിനായി ശ്മശാനത്തിന്റെ ഒരു നിശ്ചിത ഭാഗത്ത് പ്രത്യേക ചിത സ്ഥാപിക്കാനുള്ള അവകാശം നൽകിക്കൊണ്ട്, അവരുടെ ഹിന്ദു സഹോദരങ്ങളുമായി സൗഹാർദ്ദപരമായി ഒരു ശ്മശാനം പങ്കിടുന്നതിനുള്ള ഒരു മാർഗം കണ്ടെത്തിയതായി അമിക്കസ് ക്യൂറിയും റിപ്പോർട്ട് സമർപ്പിച്ചു.
അതേസമയം, ഖാസി ഹിൽസ് ഓട്ടോണമസ് ഡിസ്ട്രിക്റ്റ് കൗൺസിൽ, ജയന്തിയ ഹിൽസ് ഓട്ടോണമസ് ഡിസ്ട്രിക്റ്റ് കൗൺസിൽ, ഗാരോ ഹിൽസ് ഓട്ടോണമസ് ഡിസ്ട്രിക്റ്റ് കൗൺസിൽ എന്നീ മൂന്ന് സ്വയംഭരണ ജില്ലാ കൗൺസിലുകളെയും കക്ഷി ചേർത്തിട്ടുണ്ട്.

The Meghalaya High Court on Thursday directed the State to submit a report indicating if there is any proposal of increasing the number of cemeteries for members of the Christian community.
The bench comprising Chief Justice IP Mukerji and Justice W Diengdoh said, “The State is also directed to file a report to indicate whether it has any existing or contemplated proposal of increasing the number of cemeteries for members of the Christian community.”
The bench while hearing a PIL filed in regards to cremation of persons belonging to Khasi and Jaintia communities as well as those embracing the Hindu religion, throughout the State, decided to enlarge its scope to include the Christian community after taking judicial notice of the information that various denominations of the Christian faith are also facing similar difficulties in burying their dead in cemeteries.
“A cemetery controlled by one denomination is not allowing dead bodies of persons belonging to another denomination to be interred in the same cemetery. The result is that in various regions of the State, a long distance has to be covered by members of the bereaved family to perform the last rites of the dead. There is also similar need for sharing of cemetery and for allocation of new areas to be used as cemeteries for the Christian community,” it said.
The bench had directed the Amicus Curiae N Syngkon to hold meetings with the concerned District Magistrates and members of the community to resolve the problem faced by the Christian community and file a report.
In its previous order dated April 8, the bench had noted the proposal of the government to construct new crematoria in various regions of the State but that would take time.
The Amicus Curiae has also filed a report during the hearing and informed that after holding meetings, a way has been found for members of the Khasi and Jaintia communities to share a crematorium amicably with their Hindu brethren by allocation of separate portions of a crematorium to each of these communities and by grant of right to each community to erect a separate pyre in a designated part of a crematorium for cremating their dead.
Meanwhile, the three autonomous district councils – Khasi Hills Autonomous District Council, Jaintia Hills Autonomous District Council and Garo Hills Autonomous District Council – have also been made party respondents.

In Keralam, Aroma Chundan has won the 72nd Nehru Trophy Boat Race in a nail-biting finish at Punnamada Lake in Alappuzha. Church leaders have welcomed a ruling by a provincial top court in southern India allowing a Christian woman to seek dissolution of her marriage in a family court where she currently resides after moving out of her matrimonial home.
The Kerala High Court’s Aug. 19 ruling came on an appeal filed by a Christian woman seeking legal separation from her husband due to domestic violence.
The woman, who resides at her parental home in Kerala state’s Wayanad district, had challenged a family court order directing her to file her application in Kasargod district, where her estranged husband and his family live.

The British-era Indian Divorce Act of 1869, which governs judicial separation and marriage dissolution, among other things, for Christians in India, makes it mandatory for women to approach a family court in the place where “the marriage was solemnized, or the husband and wife reside or last resided together.”
In her appeal to the High Court, the Christian woman argued that this restriction resulted “in serious prejudice to Christian women who intend to file for divorce.”
The woman had earlier challenged the family court order before a single bench of the Kerala High Court on the grounds that she was not in a position “to travel long distances, in protracted litigations in a hostile jurisdiction.”
She pointed out that women were allowed to approach family courts where they resided under the Hindu Marriage Act, 1955, as well as the Special Marriage Act, 1954, which enables marriages between individuals of any religion, caste, or nationality, but not under the law governing Christian marriages.
The single-judge bench, in a June 30 ruling, agreed with her contentions but refused to grant her relief, holding that amending the law was the only solution and leaving it to the Indian Parliament to decide.
The judge, however, directed that the order be sent to the federal government, recommending it to amend the 1869 law.
The High Court’s division bench of Justices A K Jayasankaran Nambiar and Preeta A K, whom she approached later, allowed her appeal.
It ruled that she could file her application before a family court “having jurisdiction over the place where she is currently residing, even if that place is different from where the marriage was solemnized or where the couple last lived together.”
Church leaders hailed this Aug. 19 ruling as a “landmark decision” based on “a wise interpretation of a contentious clause.”
Father Ebigin Arackal, secretary to the Commission for Canon Law of the Kerala Region Latin Catholic Bishops’ Council, said, “We are glad that the top court, through its wise interpretation of a contentious clause, has ended decades-old discrimination against Christian women.”
Aleykutty P T, a lawyer in Kerala’s Idukki district, said Christian women were often forced to travel to places where their husbands were based, which made them insecure and sometimes even posed a threat to their lives.
“Now with this order, they can obviously choose a place where it’s safer and they get support,” she told UCA News on Aug. 20.
Govind Yadav, a lawyer at the Supreme Court in New Delhi, said this order for Kerala can become a precedent for other states to follow.
“But as long as the federal government fails to amend the colonial-era law, this discrimination against Christian women will continue,” he added.
Christians make up 2.3 percent of India’s more than 1.4 billion people; about 80 percent of whom are Hindus.
