ന്യൂഡല്‍ഹി: ക്രിസ്ത്യന്‍ വിശ്വാസത്തില്‍ പെട്ടയാളാണെന്ന കാരണത്താല്‍ റെജിമെന്റല്‍ വാരാന്ത്യ മതപരേഡുകളില്‍ പങ്കെടുക്കാന്‍ വിസമ്മതിച്ച ഇന്ത്യന്‍ കമാന്‍ഡിംഗ് ഓഫീസറെ പിരിച്ചുവിട്ട നടപടി ശരിവച്ചു ഡല്‍ഹി ഹൈക്കോടതി. പിരിച്ചുവിടല്‍ തീരുമാനം എടുക്കുന്നതിന് മുമ്പ് അദ്ദേഹത്തിന് ഒന്നിലധികം അവസരങ്ങള്‍ ലഭിച്ചിരുന്നുവെന്നും നിരവധി തവണ കൗണ്‍സിലിംഗ് നല്‍കിയിരുന്നുവെന്നും മേലുദ്യോഗസ്ഥര്‍ കോടതിയില്‍ ചൂണ്ടിക്കാട്ടി.

ഇന്ത്യന്‍ സൈന്യത്തില്‍ നിന്ന് പെന്‍ഷനും ഗ്രാറ്റുവിറ്റിയും ഇല്ലാതെ പിരിച്ചുവിട്ടതിനെ ചോദ്യം ചെയ്ത് സാമുവല്‍ കമലേശന്‍ എന്ന സൈനികനാണ് ഹര്‍ജി സമര്‍പ്പിച്ചത്. ആഴ്ചതോറുമുള്ള മതപരേഡുകളിലും ഉത്സവങ്ങളിലും സൈനികരോടൊപ്പം മന്ദിറിലേക്കും ഗുരുദ്വാരയിലേക്കും പോയിട്ടുണ്ടെന്നും എന്നാല്‍ പൂജ, ആരതി തുടങ്ങിയ ചടങ്ങുകളില്‍ ക്ഷേത്രത്തിന്റെ ശ്രീകോവിലില്‍ പ്രവേശിക്കുന്നതില്‍ നിന്ന് ഒഴിവാക്കണമെന്ന് മാത്രമാണ് ആവശ്യപ്പെട്ടതെന്ന് സൈനികന്‍ കോടതിയില്‍ വാദിച്ചു.

പ്രതികൂല സാഹചര്യങ്ങളില്‍ രാജ്യത്തിന്റെ അതിര്‍ത്തികള്‍ കാത്തുസൂക്ഷിക്കുന്നവരുടെ സമര്‍പ്പണത്തെ അഭിവാദ്യം ചെയ്യുകയും അംഗീകരിക്കുകയും ചെയ്യുന്നുവെന്ന് പറഞ്ഞ കോടതി തങ്ങളുടെ കീഴിലുള്ള സൈനികര്‍ക്ക് അവരുടെ മതപരമായ ആചാരങ്ങള്‍ പാലിക്കാന്‍ ആവശ്യമായ സൗകര്യങ്ങള്‍ നല്‍കുന്നുണ്ടെന്ന് ഉറപ്പാക്കുന്നതിന് കമാന്‍ഡിംഗ് ഓഫീസര്‍മാര്‍ക്ക് കൂടുതല്‍ ഉത്തരവാദിത്തമുണ്ടെന്നും കൂട്ടിച്ചേര്‍ത്തു. ‘നമ്മുടെ സായുധ സേനയില്‍ എല്ലാ മതങ്ങളിലും, ജാതികളിലും, പ്രദേശങ്ങളിലും, വിശ്വാസങ്ങളിലും പെട്ടവര്‍ ഉള്‍പ്പെടുന്നു. അവരുടെ ഏക മുദ്രാവാക്യം രാജ്യത്തെ ബാഹ്യ ആക്രമണങ്ങളില്‍ നിന്ന് സംരക്ഷിക്കുക എന്നതാണ്. അതിനാല്‍ മതം, ജാതി, പ്രദേശം എന്നിവയുടെ പേരില്‍ വിഭജിക്കപ്പെടുന്നതിനുപകരം അവരുടെ യൂണിഫോം കൊണ്ട് അവര്‍ ഒന്നിക്കുന്നു.’ കോടതി പറഞ്ഞു.

സിഖ്, ജാട്ട്, രജപുത്ര സേനാംഗങ്ങള്‍ അടങ്ങുന്ന 3 സ്‌ക്വാഡ്രണുകള്‍ ഉള്‍പ്പെടുന്ന 3ആം കാവല്‍റി റെജിമെന്റില്‍ ലെഫ്റ്റനന്റ് റാങ്കോടെ 2017 മാര്‍ച്ചില്‍ സാമുവല്‍ കമലേശന്‍ ഇന്ത്യന്‍ സൈന്യത്തില്‍ കമ്മീഷന്‍ ചെയ്യപ്പെട്ടു. സിഖ് സേനാംഗങ്ങള്‍ ഉള്‍പ്പെടുന്ന സ്‌ക്വാഡ്രണ്‍ ബിയുടെ ട്രൂപ്പ് ലീഡറായാണ് അദ്ദേഹത്തെ നിയമിച്ചത്. സായുധ സേനയിലെ റെജിമെന്റുകള്‍ക്ക് ചരിത്രപരമായും മതപരമായും ബന്ധപ്പെട്ട പേരുകള്‍ ഉണ്ടായിരിക്കാമെങ്കിലും റെജിമെന്റുകളില്‍ നിയമിതരായ ഉദ്യോഗസ്ഥരുടെ മതേതര ധാര്‍മ്മികതയെ ദുര്‍ബലപ്പെടുത്തുന്നില്ലെന്ന് ഹര്‍ജി തള്ളിക്കൊണ്ട് കോടതി നിരീക്ഷിച്ചു. കമലേശന്‍ തന്റെ മേലുദ്യോഗസ്ഥന്റെ നിയമപരമായ കല്‍പ്പനയ്ക്ക് മുകളിലായി തന്റെ മതത്തെ നിലനിര്‍ത്തിയെന്നും അത് വ്യക്തമായും അച്ചടക്കരാഹിത്യമാണെന്നും ബെഞ്ച് പറഞ്ഞു.

Delhi high court has upheld the 2017 termination of an Army officer who refused to participate in regimental weekly religious parades on the grounds that he belonged to the Christian faith.
Samuel Kamalesan had challenged his dismissal without pension and gratuity, and sought reinstatement in service. In a May 30 order, a division bench of Justice Navin Chawla and Justice Shalinder Kaur said: “Our armed forces comprise personnel of all religions, castes, creeds, regions and faiths, whose sole motto is to safeguard the country from external aggressions… They are united by their uniform rather than divided by their religion, caste or region.”
‘Kamalesan’s behaviour was against secular norms of Army’
Kamalesan was commissioned in Army in March 2017 as a lieutenant in the 3rd Cavalry Regiment, which comprises three squadrons of Sikh, Jat and Rajput personnel. He was made the troop leader of Squadron B, which comprises Sikh personnel.
In his plea, Kamalesan stated that his regiment maintained only a mandir and a gurdwara for its religious needs and parades, and not a sarv dharm sthal, which would serve persons of all faiths.

The case involved a Commanding Officer, commissioned in 2017, who served in a regiment comprising people of various religions. He refused to take part in the weekly religious parades and temple rituals that were part of regimental tradition.

He also stated that the unit did not have a common prayer area or ‘Sarv Dharm Sthal’ for personnel of all faiths.

Despite multiple counselling sessions by his superiors, the officer continued to defy orders, citing religious grounds. This persistent disobedience led to his termination from service without pension or gratuity. The officer then approached the court, asking for reinstatement.

The Army responded that his actions had seriously affected the morale and unity of the unit. They stressed that while religious freedom is respected in the forces, collective discipline and participation in traditional activities are essential to build camaraderie.

The judgment also clarified that although some regiments carry religious or regional names and use battle cries that may sound religious, these do not compromise the secular foundation of the armed forces. These elements are seen as motivational tools, not expressions of religious faith.
