High Court Rules in Favor of Christian Burial Rights in India
India — In a landmark decision that will have ramifications across India regarding the burial rights of Christians, the High Court of Chhattisgarh in Central India ruled in late April that a man has the right to Christian burial on his own land.
The man, Ishwar Korram, 54, died on April 25 at an area hospital. Local police prevented Ishwar’s son, Sarthik Korram, from burying his father because of his father’s Christian faith. Leaders of Ishwar’s Hindu-majority village also opposed the burial and offered no place for people of other faiths to bury their loved ones.
The high court overruled the objections of police and other local authorities in response to a petition filed by Sarthik. It directed local authorities to ensure Ishwar’s Christian funeral rites were allowed to take place on his family’s land despite vigorous opposition from village authorities.
“It is already a well-settled principle of law that Article 21 of The Constitution of India includes the right of a person to have a decent burial,” the court said in a statement. “Right to life implies a meaningful life with human dignity … and this right also extends to a person who is dead. This right exists until the death of a person, which covers the right to a decent life up to death, including a decent death procedure.”
In the days leading up to the decision, fights over the right to a Christian burial erupted between villagers supported by Hindu nationalist organizations and Christian groups. Police blocked entry into the village to help defuse the situation.
Under heavy police protection, Sarthik was able to bury his father on his father’s land on April 28.
According to members of the Bastar District Christian Seva Samiti, the high court’s order is a victory for Christians, who have been denied burial rights as a form of persecution. It is common in India for Hindu villagers to deny Christian families the right to bury their loved ones unless they return to Hinduism.

അമ്മാവൻ ദസ്രു കവാസിയും ബന്ധുവായ മഡിയയും ചേർന്ന് കോസയെ കുത്തി കൊലപ്പെടുത്തുകയായിരുന്നു. കോസയുടെയും ഭാര്യയുടെയും മതംമാറ്റം അവരുടെ കുടുംബത്തിൽ അതൃപ്തിക്ക് കാരണമായിരുന്നു. അതിനെ തുടർന്നായിരുന്നു കൊലപാതകം. ക്രിസ്തു വിശ്വാസം സ്വീകരിച്ച ശേഷം കോസ താമസിച്ചിരുന്ന ഗ്രാമത്തിലെ ആൾക്കാർ അദ്ദേഹത്തെ പ്രദേശത്ത് നിന്ന് പുറത്താക്കാനും സ്വത്തുക്കൾ പിടിച്ചെടുക്കാനും ശ്രമിച്ചിരുന്നു. അമ്മാവൻ ദസ്രു കവാസി അവരോട് തങ്ങളുടെ മതത്തിലേക്ക് തിരിച്ചു വരണമെന്ന് ആവശ്യപ്പെട്ടിരുന്നു. കാസിക്കും കുടുംബത്തിനും അതിനായി സ്വത്തും വാഗ്ദാനം ചെയ്തിരുന്നു.
ബന്ധുക്കളുടെ നിബന്ധനകൾക്ക് വഴങ്ങാൻ അദ്ദേഹം വിസമ്മതിച്ചപ്പോൾ, തർക്കം പരിഹരിക്കുന്നതിനായി ഒരു യോഗം ചേർന്നു. അതിൽ വിയോജിപ്പുള്ള രണ്ട് കക്ഷികൾക്ക് പുറമേ ഗ്രാമവാസികളും ഉണ്ടായിരുന്നു. മീറ്റിംഗിനിടെ സംഘർഷം വഷളായി, ദേഷ്യത്തിൽ ദസ്രുവും മകനും കോസ കവാസിയെ ആക്രമിക്കുകയും മരണപ്പെടുകയും ചെയ്തു. സംഭവം അറിഞ്ഞയുടൻ പോലീസ് ഇരുവരെയും അറസ്റ്റ് ചെയ്തു.
“അടുത്ത കാലത്തായി ബസ്തറിൽ ആദിവാസി ക്രിസ്ത്യാനികൾക്കും അവരുടെ സ്വത്തുക്കൾക്കും നേരെയുള്ള ആക്രമണങ്ങളിൽ ഗണ്യമായ വർധനവ് ഉണ്ടായിട്ടുണ്ട്. ഗ്രാമങ്ങളിൽ മരിച്ചവരെ സംസ്‌കരിക്കാനുള്ള അനുമതി പോലും ക്രൈസ്തവർക്ക് നിഷേധിക്കുന്ന തരത്തിൽ പോലും ആക്രമണങ്ങൽ ഉണ്ടാകുന്നുണ്ട്. ക്രിസ്ത്യൻ ഗോത്രവർഗ്ഗക്കാർ സ്വന്തം കുടുംബങ്ങൾക്കിടയിൽ പോലും ഭയത്തിലും അരക്ഷിതാവസ്ഥയിലും ജീവിക്കുന്നു” – പേര് വെളിപ്പെടുത്താത്ത പ്രദേശവാസി വെളിപ്പെടുത്തുന്നു. ഹിന്ദുത്വ സംഘടനകളാണ് ക്രിസ്ത്യാനികൾക്കെതിരായ നിരന്തരമായ അക്രമങ്ങൾ നടത്തുന്നത്.

The top court in a western Indian state has revoked an official order that prohibited a Protestant pastor and his wife from living in their village home following allegations of religious conversion.
The Goa bench of the Bombay High Court on May 8 set aside the district collector’s order, which banished Pastor Dominic D’Souza and his wife Joan Mascarenhas D’Souza from their residence in Siolim village in north Goa.The couple runs an independent Church called the Five Pillars Church.
The North Goa district collector, the highest government official in the district who also has executive magisterial powers, issued the order against the couple on March 14 under the Goa Maintenance of Public Order and Safety Act. He ordered them to leave North Goa for six months.
They were accused of using black magic and converting B Vadivel, a Hindu and native of southern Tamil Nadu state, who currently lives in Goa.
The conversion incident happened in January and Vadivel filed a police complaint against the couple. The police filed multiple cases against the couple based on which the order was issued.The pastor and his wife challenged the collector’s order before the office of the chief secretary of Goa state, which is the appellate authority.
When there was a delay, the couple approached the High Court, which directed the chief secretary to dispose of their appeals by April 26.However, the appellate authority dismissed their appeals, and the couple once again approached the High Court to quash the order.
The High Court said an externment order could not be issued as the cases against the couple were pending investigations. It further ruled that there is no link between the cases and the externment order, which was set aside.
“They are now free to return to their home,” said advocate Kapil Kerkar, who represented the couple in the High Court.
