നിർബന്ധിത മതപരിവർത്തന ആരോപണത്തിൽ സുപ്രധാന വിധിയുമായി അലഹബാദ് ഹൈക്കോടതി

ഉത്തർപ്രദേശിലെ മതപരിവർത്തന നിരോധന നിയമപ്രകാരം ബൈബിൾ വിതരണം ചെയ്യുന്നതോ മതപ്രഭാഷണം നടത്തുന്നതോ കുറ്റകരമല്ലെന്ന് അലഹബാദ് ഹൈക്കോടതിയുടെ ലക്നോ ബെഞ്ച്. ഇത് ഭരണഘടനയുടെ 25-ാം അനുച്ഛേദം ഉറപ്പുനൽകുന്ന അവകാശമാണെന്നു കോടതി ചൂണ്ടിക്കാട്ടി. പ്രലോഭനം, ബലപ്രയോഗം, വഞ്ചന എന്നിവയിലൂടെ മതം മാറ്റാൻ ശ്രമിച്ചാൽ മാത്രമേ അത് 2021ലെ നിയമപ്രകാരം കുറ്റകരമാകൂ.

രാം കേവൽ പ്രസാദും ഏതാനും പേരും ചേർന്നു നൽകിയ ഹർജിയിലാണ് കോടതിയുടെ നിർണായക ഇടപെടൽ. സുൽത്താൻപുർ ജില്ലയിലെ ധാമാർ പൊലീസ് സ്റ്റേഷനിൽ ഓഗസ്റ്റ് 17ന് തങ്ങൾക്കെതിരേ രജിസ്റ്റർ ചെയ്‌ത എഫ്ഐആർ റദ്ദാക്കണമെന്നാവശ്യപ്പെട്ടാണ് കുറ്റാരോപിതർ കോടതിയെ സമീപിച്ചത്. മതിയായ തെളിവുകളോ പരാതികളോ ഇല്ലാതെ മതപരിവർത്തന നിരോധനനിയമം ചുമത്തി കേസെടുത്ത യു പി പൊലീസിന്റെ നടപടിയെ കോടതി രൂക്ഷമായി വിമർശിച്ചു.

ഉത്തർപ്രദേശിൽ നിർബന്ധിത മതപരിവർത്തന നിരോധന നിയമം ദുരുപയോഗം ചെയ്യുന്നുവെന്ന ആരോപണങ്ങൾക്കിടെയാണു ഹൈക്കോടതിയുടെ നിർണായകമായ ഇടപെടൽ ഉണ്ടായിരിക്കുന്നത്. മതവിശ്വാസം പ്രചരിപ്പിക്കാനുള്ള പൗരന്റെ അവകാശം സംരക്ഷിക്കുന്നതാണ് ഈ വിധിയെന്ന് നിയമവിദഗ്‌ധർ ചൂണ്ടിക്കാട്ടുന്നു.

A court in Uttar Pradesh has ruled that giving out Bibles or preaching a religion cannot be treated as a crime. The Allahabad High Court criticised the state police for filing what it called a baseless case of forced religious conversion against a group of Christians in Sultanpur district.

The case was filed on August 17 against Ram Kewal Bharti and others after police accused them of creating a law and order problem and carrying out religious conversion. When Justices Abdul Moin and Babita Rani examined the police records, they found that the complaint only mentioned the recovery of an LED device and accused the group of distributing Bibles. The judges said there was no sign that anyone had been converted or pressured to convert.

The bench said in its order dated November 28, which became public on December 8, that a charge of forced conversion requires a person to claim coercion, allurement or an actual conversion. The judges said such a person did not exist in this case. They also criticised the police for adding conversion charges through a supplementary charge sheet after two months even though there was still no victim.

The court asked why the accused were arrested without any evidence and noted that the records suggested they were actually defending themselves from intruders who entered their prayer meeting. When the state lawyer tried to justify the police action, the judges asked him to show any law that makes distributing the Bible or preaching a crime. The lawyer could not provide an answer.

The court then issued a notice to the complainant, Manoj Kumar Singh, asking him to explain the basis of his allegations and how he gathered people to enter the prayer gathering. The court also asked him to share whether he had any criminal history. Singh has been given two weeks to respond, and the next hearing is set for four weeks later. The petition before the court seeks cancellation of the police case.

Catholic leader A.C. Michael welcomed the decision. He said the court had rightly upheld the constitutional right to practice and share one’s faith, but added that action should also be taken against officials who harass innocent Christians with false cases. Pastor Joy Mathew, who helps Christians in Uttar Pradesh with legal matters, said the case is part of a larger pattern. He said this is yet another example of Christians being pulled into false conversion cases and noted that no real action is ever taken against police officers who break the law.

Uttar Pradesh has reported 209 incidents of alleged Christian persecution this year, the highest in the country, according to the United Christian Forum. Christians form less than one percent of the state’s population of more than 200 million.

കോഴിക്കോട്: ഇന്ത്യൻ എംബസികളുമായി വേഗത്തിൽ ബന്ധപ്പെടാനുള്ള സംവിധാനം സാധാരണക്കാർക്ക് ഒരുക്കാൻ പ്രവാസി മലയാളികളുടെ ക്ഷേമം സംബന്ധിച്ച നിയമസഭാ സമിതി യോഗത്തിൽ തീരുമാനമായി. പ്രവാസികൾ അവധിക്കായി നാട്ടിലെത്തുന്ന ചെറിയ ഇടവേളകളിൽ ആധാർ കാർഡ്, തിരഞ്ഞെടുപ്പ് തിരിച്ചറിയൽ കാർഡ് തുടങ്ങിയവയുമായി ബന്ധപ്പെട്ട അപേക്ഷകൾ വേഗത്തിൽ തീർപ്പാക്കുന്നതിനുള്ള നടപടികൾ സ്വീകരിക്കുമെന്ന് കളക്ടർ എം.എസ്. മാധവിക്കുട്ടി സമിതിയെ അറിയിച്ചു.

പ്രവാസി ക്ഷേമനിധി പെൻഷൻ മുടങ്ങിക്കിടക്കുന്നതുമായി ബന്ധപ്പെട്ട പ്രശ്നങ്ങൾ, പെൻഷൻ ലഭിക്കുന്നതിലെ കാലതാമസം, ക്ഷേമനിധി അംഗത്വത്തിനുള്ള അപേക്ഷകൾ സമയബദ്ധമായി തീർപ്പാക്കാത്തത് തുടങ്ങിയ വിഷയങ്ങളുമായി ബന്ധപ്പെട്ട പരാതികൾ വിവിധ പ്രവാസി സംഘടനാ പ്രതിനിധികൾ യോഗത്തിൽ ഉന്നയിച്ചു. നോർക്ക സാന്ത്വനം പദ്ധതിവഴി നിലവിൽ നൽകിവരുന്ന 50,000 രൂപയുടെ ചികിത്സാസഹായം വർധിപ്പിക്കണമെന്നും ചികിത്സാസഹായവും മരണാനന്തര സഹായധനവും സമയബദ്ധമായി അനുവദിക്കണമെന്നും പ്രവാസി സംഘടനാ പ്രതിനിധികൾ ആവശ്യപ്പെട്ടു.

പ്രവാസി ക്ഷേമനിധിയിൽ അംഗമാകുന്നതിനുള്ള പ്രായപരിധി 70 വയസ്സായി ഉയർത്തണമെന്നും നാട്ടിൽ തിരിച്ചെത്തുന്ന പ്രവാസികൾക്ക് സംരംഭങ്ങൾ ആരംഭിക്കുന്നതിന് സഹായധനം നൽകണമെന്നും വിവിധ കാരണങ്ങളാൽ ആനുകൂല്യങ്ങൾ നിഷേധിക്കപ്പെടുന്ന സാഹചര്യത്തിൽ അവ ലഭ്യമാക്കുന്നതിനുള്ള വ്യവസ്ഥകളിൽ ആവശ്യമായ മാറ്റങ്ങൾ വരുത്തണമെന്നും യോഗത്തിൽ ആവശ്യമുയർന്നു.

The Kerala Assembly Committee on the Welfare of Non-Resident Keralites will take measures to help ordinary people quickly contact Indian embassies, committee members have said.

The committee, chaired by Parakkal Abdulla, MLA, held a sitting in Kozhikode on Tuesday (October 6) to discuss various issues faced by expatriates in the district, benefits due to them from the government and complaints related to welfare pensions.

MLAs K.M. Abhijith, Pazhakulam Madhu, Mohammed Muhsin, M. Vincent, and Xavier Chittilappilly attended the meeting.

A meeting of the Legislative Assembly Committee on the Welfare of Non-Resident Keralites (NRKs) has decided to set up a system to enable ordinary people to contact Indian embassies quickly.

Collector M S Madhavikutty informed the committee that measures will be taken to swiftly dispose of applications related to Aadhaar cards, electoral identity cards and similar documents during the short periods when NRIs visit home on vacation.

Representatives from various NRI organisations raised complaints at the meeting regarding issues such as suspended Pravasi Welfare Fund pension payments, delays in receiving pensions and the non-time-bound processing of applications for welfare fund membership.

In the meeting, representatives of various expatriate organizations raised grievances related to issues related to non-payment of expatriate welfare fund pension, delay in receiving pension and non-settlement of applications for welfare fund membership in a time-bound manner. The representatives of the expatriate organizations demanded an increase in the existing medical assistance of Rs 50,000 under the Norka Santhanam scheme and timely release of medical assistance and post-mortem assistance.

It was demanded in the meeting that the age limit for becoming a member of the Non-Resident Welfare Fund should be increased to 70 years, assistance should be provided to expatriates returning home to start enterprises and necessary changes should be made in the conditions for providing benefits in case they are denied due to various reasons.

Committee chairman Parakkal Abdulla presided over the meeting. Mr. K.M. Abhijith, Pazhakulam Madhu, Muhammed Muhasin and others. Vincent, Xavier Chittilappilly and NORKA committee joint secretary Md. Jayashree, Dy. K. Representatives of various organisations had participated.
