ന്യൂഡൽഹി: വിദേശ സംഭാവന നിയന്ത്രണ നിയമമായ എഫ്സിആർഎയുടെ ചട്ടങ്ങളിൽ കേന്ദ്രസർക്കാർ കൂടുതൽ നിയന്ത്രണങ്ങൾ ഏർപ്പെടുത്തി. 2011ലെ ചട്ടങ്ങളിൽ വരുത്തിയ ഭേദഗതികൾ തിങ്കളാഴ്ച മുതൽ പ്രാബല്യത്തിൽ വന്നു.

പുതിയ വ്യവസ്ഥപ്രകാരം, പൊതുവായ ലക്ഷ്യങ്ങളും പ്രവർത്തനങ്ങളും ചൂണ്ടിക്കാട്ടി ഇനി വിദേശ ധനസഹായത്തിന് അനുമതി തേടാനാകില്ല. സ്ഥാപനങ്ങൾ അവരുടെ പ്രവർത്തനലക്ഷ്യം വ്യക്തമായി നിർവചിക്കണം. മതം, സംസ്കാരം, സാമ്പത്തികം, വിദ്യാഭ്യാസം, സാമൂഹികം എന്നീ അഞ്ച് വിഭാഗങ്ങളിലായി നിശ്ചയിച്ചിരിക്കുന്ന 105 പ്രവർത്തനങ്ങളിൽ ഏതെങ്കിലും ഒന്നുമായി ബന്ധമുള്ളതാണെന്ന് വ്യക്തമാക്കിയാൽ മാത്രമേ എഫ്സിആർഎ രജിസ്ട്രേഷൻ അനുവദിക്കൂ.

മതവിഭാഗത്തിൽ ആരാധനാലയങ്ങളുടെ നിർമാണം, നവീകരണം, വിശുദ്ധ ഗ്രന്ഥങ്ങളുടെ അച്ചടി തുടങ്ങിയ 18 പ്രവർത്തനങ്ങൾ ഉൾപ്പെടുത്തിയിട്ടുണ്ട്. അതേസമയം, മതപരിവർത്തന പ്രവർത്തനങ്ങൾക്ക് അനുമതിയില്ലെന്നും ചില മേഖലകളിലെ രാഷ്ട്രീയ പ്രവർത്തനങ്ങൾ നിയന്ത്രണവിധേയമാണെന്നും ചട്ടങ്ങളിൽ വ്യക്തമാക്കുന്നു.

The Union government has notified fresh amendments to the Foreign Contribution (Regulation) Rules, tightening disclosure requirements for NGOs receiving foreign funds while explicitly keeping religious conversion activities outside the ambit of permissible foreign-funded religious work.

The amendments, notified on Monday by the Ministry of Home Affairs (MHA), require NGOs seeking FCRA registration or prior permission to provide detailed information about their area of operations, objectives, operating states, foreign donors, social media accounts, utilisation of foreign contributions and the specific purpose for which foreign funding is being sought.

The amended rules also strengthen donor disclosures, spending conditions and field verification requirements for foreign-funded activities.

Foreign Nationals Barred From Key NGO Posts

Under the new rules, foreign nationals—except those of Indian origin—will ordinarily not be eligible to hold key positions in NGOs seeking registration or prior permission under the Foreign Contribution (Regulation) Act.

“After sub-rule (5), the following Explanations shall be inserted, namely:— ‘Explanation 1.— It is hereby clarified that an association having foreign nationals, other than those of Indian origin, as its key functionaries shall ordinarily not be considered eligible for grant of registration or prior permission under the Act’,” the notification states.

However, the rules provide an exception. The Centre may, on a case-by-case basis, permit foreign nationals to serve as key functionaries in an association.

“Central Government may, by order, specify such cases or circumstances in which foreign nationals may be permitted to be key functionaries of an association for the purposes of consideration of registration or prior permission, and the conditions to be fulfilled for such consideration,” the notification states.

NGOs Must Declare Their Objectives
The amendments make it mandatory for NGOs to clearly state their objectives and utilise foreign contributions only for those purposes.

Explanation 2 under sub-rule (5) of the Foreign Contribution (Regulation) Rules states: “It is hereby clarified that the foreign contribution so received shall be utilised only for activities carried out in India in accordance with the association’s stated objectives and for the purposes for which such contribution has been received.”

Stricter Conditions For Utilisation Of Funds
The amended rules require NGOs to utilise at least 75 per cent of a foreign contribution instalment before seeking release of a second or subsequent instalment.

Under the new proviso to Rule 9A: “Provided that an association seeking release of the second or any subsequent instalment shall make an application in Form FC-3BB and the second or any subsequent instalment shall be released only after utilisation of seventy-five per cent. of the foreign contribution received in the previous instalment and after field inquiry of such utilisation.”

The rules also introduce a minimum activity threshold for organisations seeking renewal of registration.

A new Rule 14A states: “For the purposes of cancellation under section 14 and renewal under section 16, an association shall be deemed to have undertaken reasonable activity in its chosen field for the benefit of society if it has utilised foreign contribution of not less than ten lakh rupees in the last two financial years for such purpose.”

In effect, NGOs will now be required to demonstrate utilisation of at least Rs 10 lakh in foreign contributions over the previous two financial years to be considered as having undertaken reasonable activity.

Prior Approval For Change In Operations
The amendments also introduce stricter norms for NGOs seeking to expand or alter their operational scope.

Under newly inserted Rule 17B, an association wishing to add or remove any purpose, state or Union Territory from its registration certificate must seek prior approval from the Centre through Form FC-6F.

The application must be accompanied by a governing body resolution and the prescribed fee. “The Central Government may, after such inquiry as it deems fit, approve or reject the application under sub-rule (1),” the notification states.

Religious Activities Allowed, Proselytisation Excluded
The amended rules codify the activities that qualify as religious work under the FCRA framework.

Permissible activities include construction, renovation and maintenance of places of worship; preservation, printing, translation and digitisation of sacred scriptures; preservation of institutions engaged in religious studies; pilgrim amenities; dharamshalas, langars and community kitchens; religious education and spiritual discourses; devotional music and liturgical arts; preservation of indigenous and tribal faith traditions; protection of religious heritage sites; inter-faith dialogue programmes; faith-based publications; religious libraries and museums; counselling and de-addiction centres run by religious organisations; training in traditional sacred crafts; and development and maintenance of burial and cremation grounds.

However, the rules specifically exclude proselytisation from permissible foreign-funded religious activities.

For instance, activities such as religious education, satsangs, discourses and meditation retreats are permitted only when they do not involve proselytisation. Similarly, efforts to document or revive indigenous and tribal faith practices are allowed, provided they do not involve religious conversion.

Codified Categories For Other NGOs
The amendments also define permissible activities for cultural organisations, including archaeological exploration, establishment and maintenance of museums, promotion of folk culture, support for classical art forms and preservation of non-religious manuscripts.

The government has similarly codified categories for organisations working in education, social welfare, economic development, youth affairs and sports development.

As a result, NGOs seeking FCRA registration or prior permission will now be required to select their area of work from a pre-specified list of approved activities.

Indian court says Christian woman can file for divorce where she lives

Church leaders have welcomed a ruling by a provincial top court in southern India allowing a Christian woman to seek dissolution of her marriage in a family court where she currently resides after moving out of her matrimonial home.

The Kerala High Court’s Aug. 19 ruling came on an appeal filed by a Christian woman seeking legal separation from her husband due to domestic violence.

The woman, who resides at her parental home in Kerala state’s Wayanad district, had challenged a family court order directing her to file her application in Kasargod district, where her estranged husband and his family live.

Global Catholic
The British-era Indian Divorce Act of 1869, which governs judicial separation and marriage dissolution, among other things, for Christians in India, makes it mandatory for women to approach a family court in the place where “the marriage was solemnized, or the husband and wife reside or last resided together.”

In her appeal to the High Court, the Christian woman argued that this restriction resulted “in serious prejudice to Christian women who intend to file for divorce.”

The woman had earlier challenged the family court order before a single bench of the Kerala High Court on the grounds that she was not in a position “to travel long distances, in protracted litigations in a hostile jurisdiction.”

She pointed out that women were allowed to approach family courts where they resided under the Hindu Marriage Act, 1955, as well as the Special Marriage Act, 1954, which enables marriages between individuals of any religion, caste, or nationality, but not under the law governing Christian marriages.

The single-judge bench, in a June 30 ruling, agreed with her contentions but refused to grant her relief, holding that amending the law was the only solution and leaving it to the Indian Parliament to decide.

The judge, however, directed that the order be sent to the federal government, recommending it to amend the 1869 law.

The High Court’s division bench of Justices A K Jayasankaran Nambiar and Preeta A K, whom she approached later, allowed her appeal.

It ruled that she could file her application before a family court “having jurisdiction over the place where she is currently residing, even if that place is different from where the marriage was solemnized or where the couple last lived together.”

Church leaders hailed this Aug. 19 ruling as a “landmark decision” based on “a wise interpretation of a contentious clause.”

Father Ebigin Arackal, secretary to the Commission for Canon Law of the Kerala Region Latin Catholic Bishops’ Council, said, “We are glad that the top court, through its wise interpretation of a contentious clause, has ended decades-old discrimination against Christian women.”

Aleykutty P T, a lawyer in Kerala’s Idukki district, said Christian women were often forced to travel to places where their husbands were based, which made them insecure and sometimes even posed a threat to their lives.

“Now with this order, they can obviously choose a place where it’s safer and they get support,” she told UCA News on Aug. 20.

Govind Yadav, a lawyer at the Supreme Court in New Delhi, said this order for Kerala can become a precedent for other states to follow.

“But as long as the federal government fails to amend the colonial-era law, this discrimination against Christian women will continue,” he added.

Christians make up 2.3 percent of India’s more than 1.4 billion people; about 80 percent of whom are Hindus.
