വിദേശ ഫണ്ട് വാങ്ങുന്ന എൻജിഒകളുടെ റജിസ്ട്രേഷൻ റദ്ദാക്കുമെന്ന് സർക്കാർ മുന്നറിയിപ്പ്
ലാഭേച്ഛയില്ലാത്ത സർക്കാർ ഇതര സംഘടനകൾക്ക് പൂട്ടിടാൻ (എൻ.ജി.ഒ) കേന്ദ്ര സർക്കാർ നീക്കം. മൂന്ന് വർഷമായി പ്രവർത്തന രഹിതമായ എൻ.ജി.ഒകൾക്ക് കേന്ദ്ര ആഭ്യന്തര മന്ത്രാലയം കാരണം കാണിക്കൽ നോട്ടിസ് അയച്ചു. 2021 മുതൽ തുടർച്ചയായി പ്രവർത്തനം നിലച്ച സംഘടനകൾക്കാണ് നോട്ടിസ്. 2010ലെ വിദേശ സംഭാവന (നിയന്ത്രണ) നിയമ പ്രകാരം (എഫ്.സി.ആർ.എ) റജിസ്ട്രേഷൻ റദ്ദാക്കാതിരിക്കണമെങ്കിൽ കാരണം കാണിക്കണമെന്നാണ് ആഭ്യന്തര മന്ത്രാലയം ആവശ്യപ്പെട്ടത്.
എൻ.ജി.ഒകൾക്കും സാമൂഹിക പ്രവർത്തകർക്കും വിദേശ സംഭാവന ലഭിക്കുന്നത് നിയന്ത്രിക്കുന്ന നിയമമാണ് എഫ്.സി.ആർ.എ. 2020ൽ ഈ നിയമം സർക്കാർ കൂടുതൽ കടുപ്പിച്ചിരുന്നു. എഫ്.സി.ആർ.എ റജിസ്ട്രേഷൻ റദ്ദാക്കിയാൽ എൻ.ജി.ഒകൾക്ക് വിദേശ ധനസഹായം ലഭിക്കില്ല. എൻ.ജി.ഒകളുടെ പ്രവർത്തനവും ലക്ഷ്യവും താൽപര്യങ്ങളും വിദേശ സംഭാവന ഉറവിടവും സംബന്ധിച്ച് സർക്കാർ നിരീക്ഷണം ശക്തമാക്കിയതിന് പിന്നാലെയാണ് പുതിയ നീക്കം.
വിദേശത്തുനിന്ന് ലഭിച്ച സംഭാവന ഉപയോഗിക്കാതിരുന്നതിനെ കുറിച്ച് 21 ദിവസത്തിനകം രേഖകൾ സഹിതം വിശദീകരണം നൽകണമെന്നാണ് ആഭ്യന്തര മന്ത്രാലയത്തിന്റെ നോട്ടിസ് പറയുന്നത്. മറുപടി നൽകിയില്ലെങ്കിൽ സംഘടനകൾക്കെതിരെ നടപടി സ്വീകരിക്കുമെന്നും നോട്ടിസ് മുന്നറിയിപ്പ് നൽകി. എഫ്.സി.ആർ.എ നിയമ പ്രകാരം രണ്ട് വർഷം തുടർച്ചയായി പ്രവർത്തിച്ചില്ലെങ്കിൽ സംഘടനകളുടെ റജിസ്ട്രേഷൻ റദ്ദാക്കാൻ സർക്കാറിന് കഴിയും. ഈ നിയമ പ്രകാരം ജീവകാരുണ്യ രംഗത്ത് പ്രവർത്തിക്കുന്ന നിരവധി ചെറിയ സംഘടനകളെയാണ് സർക്കാർ കരിമ്പട്ടികയിൽപെടുത്തിയത്.
അതേസമയം, ആദ്യമായാണ് സർക്കാർ എഫ്.സി.ആർ.എയുടെ സെക്ഷൻ 14(1)(ഇ) വകുപ്പ് പ്രയോഗിക്കുന്നതെന്ന് ചാരിറ്റബിൾ സംഘടനകളുടെ ഓഡിറ്റിങ്ങിൽ വിദഗ്ധനായ മുതിർന്ന ചാർട്ടേഡ് അക്കൗണ്ടന്റ് ഗൗതം ഷാ പറഞ്ഞു. വിദേശ ഫണ്ട് ഉപയോഗിക്കാതിരുന്നാൽ വഴിതിരിച്ചുവിട്ടെന്നോ ദുരുപയോഗം ചെയ്തെന്നോ സ്ഥാപിക്കാൻ കഴിയില്ല. പദ്ധതികൾക്ക് അംഗീകാരം വൈകൽ, സർക്കാർ അനുമതി ലഭിക്കാനുള്ള കാലതാമസം, സ്ഥാപനത്തിന് നേരിടേണ്ടി വരുന്ന പ്രതിസന്ധികൾ തുടങ്ങിയ വിവിധ കാരണങ്ങളാൽ വിദേശ സംഭാവന ഉപയോഗിക്കപ്പെടാതിരിക്കാം. ഫണ്ടുകൾ ശരിയായി കണക്കിൽ വെക്കുകയും ബാങ്ക് അക്കൗണ്ടിൽ സുരക്ഷിതമായി സൂക്ഷിക്കുകയും വഴിതിരിച്ചുവിടാതിരിക്കുകയും ചെയ്യുന്നിടത്തോളം കാലം എഫ്.സി.ആർ.എ റജിസ്ട്രേഷൻ റദ്ദാക്കൽ നിയമവിരുദ്ധമാണെന്നും അദ്ദേഹം വ്യക്തമാക്കി.

The Union home ministry has warned that non-government organisations (NGOs) that receive and utilise foreign funds without having a licence under the foreign contribution regulation act (FCRA) or after its expiry will be penalised, according to a communication by the ministry on Tuesday.
The ministry came across some instances of credit or debit in the accounts of NGOs without a licence, which caused it to issue a public notice on Tuesday.
All NGOs receiving foreign funds have to be mandatorily registered under the FCRA and they have to utilise such funds only for the purposes these have been received.
Besides, those who get the FCRA registration certificate must renew it within six months before the expiry of the period of the registration and if not done, their registration ceases to exist and they can’t receive or utilise foreign contribution.
“However, instances have come to the notice to this ministry where credit or debit of the FC (foreign contribution) has been noticed into the accounts of the NGOs/associations who have not been granted registration/prior permission/renewal under the FCRA 2010 or such NGOs/associations whose registration has ceased on expiry of validity period or whose registration has been cancelled,” the notice stated.
It added that any receipt or utilisation of the FC without valid registration is violation of the provisions of the FCRA 2010.
Accordingly, it said, “any transaction in FCRA accounts/FCRA utilisation accounts of the NGO/association whose FCRA registration has been cancelled or ceased or validity expired would amount to violation of FCRA 2010 and is liable for penal action”.
In November 2024, the home ministry said that any non-government organisation involved in anti-development activities, religious conversions or incites protests with malicious intentions or has links with radical organisations will be refused foreign contribution regulation act (FCRA) licence.
According to the MHA data, as many as 16,091 NGOs have FCRA licences as of date while licences of 20,713 organisations have been cancelled.
The Centre tightened the FCRA in 2020 by making several amendments. It even canceled the licences of Rajiv Gandhi Foundation (RGF) and Rajiv Gandhi Charitable Trust (RGCT) in 2022 accusing them of violating the law.
The FCRA unit of the MHA carried out inspections or audits of at least 335 NGOs and associations registered or granted prior permission under FCRA between 2019 and 2022 to see if foreign funding rules were being followed by them.
The FCRA act – amended in September 2020 – barred public servants from receiving foreign funding and made Aadhaar mandatory for every office-bearer of the NGOs. The amended law also bars organisations from using more than 20% of foreign funds for administrative purposes. The limit was hitherto 50%.

Indian court says Christian woman can file for divorce where she lives
Church leaders have welcomed a ruling by a provincial top court in southern India allowing a Christian woman to seek dissolution of her marriage in a family court where she currently resides after moving out of her matrimonial home.
The Kerala High Court’s Aug. 19 ruling came on an appeal filed by a Christian woman seeking legal separation from her husband due to domestic violence.
The woman, who resides at her parental home in Kerala state’s Wayanad district, had challenged a family court order directing her to file her application in Kasargod district, where her estranged husband and his family live.

The British-era Indian Divorce Act of 1869, which governs judicial separation and marriage dissolution, among other things, for Christians in India, makes it mandatory for women to approach a family court in the place where “the marriage was solemnized, or the husband and wife reside or last resided together.”
In her appeal to the High Court, the Christian woman argued that this restriction resulted “in serious prejudice to Christian women who intend to file for divorce.”
The woman had earlier challenged the family court order before a single bench of the Kerala High Court on the grounds that she was not in a position “to travel long distances, in protracted litigations in a hostile jurisdiction.”
She pointed out that women were allowed to approach family courts where they resided under the Hindu Marriage Act, 1955, as well as the Special Marriage Act, 1954, which enables marriages between individuals of any religion, caste, or nationality, but not under the law governing Christian marriages.
The single-judge bench, in a June 30 ruling, agreed with her contentions but refused to grant her relief, holding that amending the law was the only solution and leaving it to the Indian Parliament to decide.
The judge, however, directed that the order be sent to the federal government, recommending it to amend the 1869 law.
The High Court’s division bench of Justices A K Jayasankaran Nambiar and Preeta A K, whom she approached later, allowed her appeal.
It ruled that she could file her application before a family court “having jurisdiction over the place where she is currently residing, even if that place is different from where the marriage was solemnized or where the couple last lived together.”
Church leaders hailed this Aug. 19 ruling as a “landmark decision” based on “a wise interpretation of a contentious clause.”
Father Ebigin Arackal, secretary to the Commission for Canon Law of the Kerala Region Latin Catholic Bishops’ Council, said, “We are glad that the top court, through its wise interpretation of a contentious clause, has ended decades-old discrimination against Christian women.”
Aleykutty P T, a lawyer in Kerala’s Idukki district, said Christian women were often forced to travel to places where their husbands were based, which made them insecure and sometimes even posed a threat to their lives.
“Now with this order, they can obviously choose a place where it’s safer and they get support,” she told UCA News on Aug. 20.
Govind Yadav, a lawyer at the Supreme Court in New Delhi, said this order for Kerala can become a precedent for other states to follow.
“But as long as the federal government fails to amend the colonial-era law, this discrimination against Christian women will continue,” he added.
Christians make up 2.3 percent of India’s more than 1.4 billion people; about 80 percent of whom are Hindus.
