Published

The top court in the northern Indian state of Uttar Pradesh has dismissed an appeal by the Christian community to allot a piece of barren public land for a cemetery, citing legal restrictions.

The Allahabad High Court bench of judges J.J. Munir and Indrajeet Shukla, in their Oct. 12 judgment, noted that they recognize the community’s right to religious freedom, but this does not grant it the right to demand a specific piece of land from the government for a cemetery.

The court noted that converting land entrusted to a local body into a public utility like a graveyard was “an executive decision” based on various factors. The authorities could consider such a request in the larger public interest if there was a shortage of space, it added.

The court order came in response to a petition filed by the Christian Community Welfare Society after the Ghaziabad district magistrate rejected its appeal on Jan. 7 for allotting land for a cemetery, citing a shortage of space for Christian burials.

It sought 0.3420 hectares of barren land in Visokhar village in Modi Nagar sub-district. However, the land was not reserved to serve as a burial ground, prompting the society to approach the district authorities.

Vinaya Kumar Paul, the president of the society, said: “There was no objection from anybody to allotting the barren land for Christians.”

But both the magistrate — the top government official in the district — and the court noted the land was indeed barren but did not approve the request for getting the land converted to a Christian cemetery.

The district magistrate delegated his authority to an additional district magistrate who prepared an adverse report with a communal angle, and the court accepted it, leading to denial of burial ground to Christians, people familiar with the case alleged.

“The court order appears more of a legal stickler rather than addressing the larger social and religious requirements of a community,” Divine Word priest Babu Joseph, former spokesperson of the Catholic Bishops Conference of India, told.

“The point in the whole appeal of the Christian society was to allot a barren land for conducting their burial services since they have run short of space in the current location, and that is legitimate as in the case of any community,” said the priest based in the national capital, New Delhi.

“But twinning it with a more fundamental aspect of religious freedom is perhaps an overreach of the actual intent of the petitioner,” the priest added.

Uttar Pradesh, India’s most populous state with about 244 million people, is ruled by the pro-Hindu Bharatiya Janata Party (BJP) of Prime Minister Narendra Modi.

The top court in the central Indian state of Chhattisgarh has granted bail to a Christian leader who spent more than two months in jail for allegedly posting an objectionable comment on social media that police say hurt the religious sentiments of Hindus.

Protestant pastor Arun Pannalal, president of the Chhattisgarh Christian Forum, walked out of Central Jail in the state capital Raipur around 8 p.m. on Oct. 15.

“We are all relieved and thank the Lord, our mighty Savior, for his release,” his son Vaibhav Pannalal told.

The Chhattisgarh High Court’s Bilaspur bench ordered his release on Oct.14.

The 76-year-old pastor, who is a vocal critic of the ruling Bharatiya Janata Party (BJP) in the state, was arrested by police at his home in the state capital Raipur on Aug. 7.

In his order, Justice Rakesh Mohan Pande referred to Pannalal’s old age and the fact that he had been in judicial custody for more than two months while noting that the conclusion of the trial is likely to take some time.

“Without commenting on the merits of the matter, this court is inclined to enlarge the applicant on regular bail,” he said.

Vaibhav Pannalal said his father looked frail, having lost 12 kilograms in jail and needed support to walk as he suffered from spondylitis and severe backache.

“He was imprisoned just to harass, intimidate and gag his voice, which he used to raise for defending the fundamental rights of the oppressed tribal Christians,” he said.

Bishop Paul Toppo of Raigarh in the state expressed happiness at the release of “the protector of voiceless Dalit [formerly untouchable] and tribal Christians.”

The prelate said Pannalal was the first to hit the street whenever there was injustice and persecution of the Christian community.

John Dayal, spokesperson of All India Catholic Union, said the Christian community was glad the defender of religious freedom is back with his family.

“There is little doubt in our mind that the case had been registered against him as part of a well-thought-out plan to target him and silence his voice,” he said.

Pannalal’s arrest came within days of the new Chhattisgarh Freedom of Religion Bill, 2026, passed by the State Assembly on March 19, taking effect after it was published in the state gazette on Aug. 4.

According to the first information report (FIR), which formally opens a criminal case in India, Pannalal allegedly made a “highly objectionable comment” on a Facebook post by Hansraj Goyal questioning Hindu religious beliefs while referring to several Hindu deities.

The complaint was filed by Amit Chimnani, a spokesperson of the pro-Hindu BJP, which rules Chhattisgarh.

The arrest worried Christians as it came within days of the state joining 12 other states in India to enforce “a weaponized law” against conversion.

The new law would create an environment in which a person’s voluntary religious choice is viewed with suspicion, according to community leaders.

Christians make up less than two percent of the state’s nearly 30 million population.

The Supreme Court on Thursday upheld the Madras High Court’s decision that a person who converts to Islam from the Hindu social order cannot claim Backward Class (BC) reservation benefits solely on the basis of their pre-conversion social status. A bench of Justices PK Mishra and Shree Chandrashekhar dismissed the Tamil Nadu government’s appeal against the High Court’s order striking down a state government decision on reservation benefits for seven Backward Class Muslim communities.

What did the Supreme Court say on BC reservation after conversion?
The Supreme Court observed that a person converting from the Hindu social order to a non-Hindu social order cannot claim affirmative action benefits under Article 16(4) of the Constitution merely because of the social backwardness associated with their status before conversion.

“A person who converts from Hindu social order to a non-Hindu social order cannot claim affirmative action under article 16(4) of the Constitution merely on the basis of the social backwardness associated with his pre-conversion status,” the bench said while dismissing the state’s plea.

The bench also referred to the Constitution (Scheduled Castes) Order, 1950, which restricts Scheduled Caste status to people professing Hinduism, Sikhism or Buddhism.

It further observed that backwardness in a person’s previous social order cannot, by itself, be carried forward to grant them Backward Class status in the religion they convert to. The court added that a person professing a religion other than Hinduism, Sikhism or Buddhism cannot be deemed to be a member of a Scheduled Caste under paragraph 3 of the order.

Why did Tamil Nadu challenge the Madras High Court order?
The Tamil Nadu government approached the Supreme Court against the Madras High Court’s June 25 judgment, which struck down a government order issued on March 9, 2024.

The state government order allowed people belonging to Backward Classes (BCs), Most Backward Classes (MBCs), Denotified Communities or Scheduled Castes to be treated as Backward Class Muslims after converting to Islam, subject to the prescribed conditions.

Under the order, eligible converts could be issued community certificates identifying them as members of one of seven notified Muslim communities recognised under the state’s BC category. The certificates would allow them to claim reservation benefits.

The state government argued that the order was introduced to ensure that people belonging to socially and educationally backward communities did not lose reservation benefits solely because they had converted to Islam.

It maintained that the decision followed detailed deliberations and that extending these benefits to such individuals would not disturb the social balance.

What did the Madras High Court say in its June 25 judgment?
The Madras High Court had held that the March 2024 government order was contrary to judicial pronouncements by the High Court and the Supreme Court concerning the status of people who convert to Islam.

The High Court observed that a person converting to Islam could be treated as a Muslim but could not automatically retain or claim a caste-based status from their previous religion for reservation purposes.

The judgment also referred to arguments about the principles of social equality associated with Islam and Christianity, noting that religious conversion raised questions about claims based on the caste hierarchy of the Hindu social order.

The High Court’s decision came in a case involving Sameer Ahamed, who converted to Islam in 2015, changed his name and married according to his adopted religion.

How did the case involving Sameer Ahamed begin?
After his conversion, Ahamed applied for a community certificate identifying him as a ‘Muslim Lebbai’, one of the seven Backward Class Muslim communities recognised under the Tamil Nadu government’s March 2024 order.

When the tehsildar rejected his application, Ahamed approached the Madras High Court, relying on the government order to support his claim.

The state government defended the order, arguing that its purpose was to protect reservation benefits for people who already belonged to socially and educationally backward communities before converting to Islam.

However, the High Court struck down the order on June 25, prompting the state government to challenge the decision before the Supreme Court.

With the Supreme Court dismissing the appeal, the Madras High Court’s decision striking down the March 2024 government order remains in force.
