വോട്ടർ പട്ടികയിൽ പേരില്ലെങ്കിലും പൗരത്വം നഷ്ടമാകില്ല: എസ്ഐആർ നടപടികൾ ശരിവച്ച് സുപ്രീംകോടതി
തെരഞ്ഞെടുപ്പ് കമീഷൻ്റെ തീവ്രവോട്ടർ പട്ടിക പരിഷ്കരണ നടപടികൾക്ക് പൂർണ അംഗീകാരം നൽകി സുപ്രീംകോടതി വിധി. എസ്ഐആർ നടപടികൾ നിലവിലുള്ള നിയമങ്ങളെയോ ഭരണഘടനാ വ്യവസ്ഥകളെയോ യാതൊരു തരത്തിലും ലംഘിക്കുന്നില്ലെന്ന് കോടതി വ്യക്തമാക്കി. കൃത്യവും സമഗ്രവുമായ ഒരു വോട്ടർ പട്ടിക തയ്യാറാക്കുന്നതിലേക്കുള്ള സുപ്രധാന ചുവടുവെപ്പായ ഈ നടപടി, ഭരണഘടനയ്ക്ക് കൂടുതൽ കരുത്തും ജീവനും പകരുന്നതാണെന്നും സുപ്രീംകോടതി നിരീക്ഷിച്ചു.
വോട്ടർ പട്ടികയിൽ നിന്ന് ഒരാളുടെ പേര് നീക്കം ചെയ്യപ്പെടുന്നത് അയാളുടെ പൗരത്വം നിശ്ചയിക്കുന്നതിനുള്ള മാനദണ്ഡമായി കണക്കാക്കാനാകില്ലെന്ന് കോടതി പ്രത്യേകം വ്യക്തമാക്കി. തീവ്രവോട്ടർ പട്ടിക പരിഷ്‌കരണം എന്നത് പിൻവാതിലിലൂടെയുള്ള പൗരത്വ പരിശോധനയാണെന്ന് ആരോപിച്ച് ഹർജിക്കാരും പ്രതിപക്ഷ പാർട്ടികളും ഉയർത്തിയ വാദങ്ങളെ പൂർണമായും തള്ളിക്കൊണ്ടാണ് സുപ്രീംകോടതിയുടെ ഈ സുപ്രധാന വിധി വന്നിട്ടുള്ളത്.
സ്വതന്ത്രവും നീതിയുക്തവുമായ തിരഞ്ഞെടുപ്പ് നടത്തുക എന്ന ഭരണഘടനാപരമായ ലക്ഷ്യം കൈവരിക്കുന്നതിനായി ഇത്തരം പരിഷ്കരണ നടപടികൾ അനിവാര്യമാണെന്ന് കോടതി ചൂണ്ടിക്കാട്ടി. തിരഞ്ഞെടുപ്പ് പ്രക്രിയയുടെ സുതാര്യതയും പൗരന്മാരുടെ ഭരണഘടനാപരമായ അവകാശങ്ങളും തമ്മിൽ കൃത്യമായ സന്തുലിതാവസ്ഥ ഉറപ്പാക്കാൻ തെരഞ്ഞെടുപ്പ് കമീഷൻ സ്വീകരിച്ച നടപടികൾക്ക് ഇതിലൂടെ സാധിച്ചിട്ടുണ്ട്.
വോട്ടർ പട്ടിക തയ്യാറാക്കുന്നതുമായി ബന്ധപ്പെട്ട് പൗരത്വത്തിൽ എന്തെങ്കിലും സംശയങ്ങളുണ്ടെങ്കിൽ അത് തീർക്കാനുള്ള പൂർണ അധികാരം കമീഷനുണ്ടെന്നും കോടതി ഉത്തരവിൽ വിശദീകരിക്കുന്നു. എസ്ഐആർ പ്രക്രിയയിൽ പങ്കാളികളാകുന്നതിനും പരാതികൾ പരിഹരിക്കുന്നതിനുമായി നിരവധി അവസരങ്ങൾ ഇതിനകം നൽകിയിട്ടുണ്ടെന്ന് കോടതി വിലയിരുത്തി. സുപ്രീംകോടതിയുടെ മുൻ ഇടക്കാല ഉത്തരവുകളിലൂടെ തന്നെ ഈ തീവ്രവോട്ടർ പട്ടിക പരിഷ്‌കരണം കൂടുതൽ സമഗ്രമാക്കാൻ സാധിച്ചിട്ടുണ്ടെന്നും വിധിന്യായത്തിൽ വ്യക്തമാക്കുന്നുണ്ട്.

The Supreme Court on Wednesday held that the Election Commission of India, in the course of preparing or revising electoral rolls, is undoubtedly empowered to examine questions bearing upon citizenship. However, such an inquiry can only be undertaken from the limited standpoint of determining inclusion or exclusion from the electoral rolls.
The court clarified that such an exercise of exclusion or inclusion must be carried out with due regard to the presumption operating in favour of an elector whose name already exists on the rolls.
Free and fair elections do not rest merely upon mechanics of polling, the top court said, upholding the power of the Election Commission to conduct a Special Intensive Revision (SIR) exercise of electoral rolls.
The top court made it clear that an exclusion from a voter list does not mean that a person loses citizenship.
“If a citizen does not appear on electoral roll that does not mean the citizen was unable to prove his citizenship, but shows the inability of the Election Commission to verify citizenship,” the court said.
Importantly, the court held that entirety of this SIR exercise remains open to judicial review, thereby ensuring that the inquiry is conducted in accordance with law and within the bounds of procedural fairness.
“We have no hesitation in adding that this assessment is necessarily prima facie and contextual. Where the material furnished by an individual does not inspire confidence or gives rise to doubt, the Commission would be within its authority to decline enrolment or to initiate action for deletion strictly in accordance with law,” the court said.
The court said the deletion of person from voter list must be understood in its proper perspective.
“It does not amount to a declaration that the individual is not a citizen of India. It merely reflects the Commission’s inability to be satisfied, for electoral purposes, that the statutory conditions stand fulfilled.”
The court said that the consequence of such a citizenship determination is correspondingly limited.
“It affects the individual’s entitlement to be included in the electoral rolls and thereby the right to participate in the electoral process,” the court said.
The court clarified that deletion does not, however, operate to divest the individual of claims to citizenship, nor does it foreclose adjudication of that question by the competent authority under the Citizenship Act.
Moreover, in cases where the Commission is not satisfied that a person fulfils the statutory conditions for inclusion in the electoral rolls, it would be incumbent upon the Commission to refer such an individual to the competent authority of the Union Government for adjudication in accordance with law.
“The Commission’s determination, being confined to electoral purposes, cannot assume finality on the question of citizenship. Any deletion effected on this ground shall therefore remain subject to the outcome of adjudication by the competent authority,” the court said.

എല്ലാ പ്രിയ ദൈവജനവും പാസ്റ്റർ ബൽവിന്ദർ പാലിന്റെ കുടുംബത്തെ ഓർത്തും, പഞ്ചാബിലെ സുവിശേഷ പ്രവർത്തനങ്ങളെയും, ദൈവ സഭകളെയും, ദൈവമക്കളെയും, ദൈവദാസന്മാരെയും അവരുടെ കുടുംബങ്ങളെയും ഓർത്തും, ഈ ക്രൂര കൃത്യം ചെയ്ത സുവിശേഷ വിരോധികളോട് കർത്താവ് ക്ഷമിക്കേണ്ടതിനും, അവർ എത്രയും വേഗം യേശുക്രിസ്തുവിന്റെ സ്നേഹം തിരിച്ചറിയേണ്ടതിനും വേണ്ടി ശക്തമായി പ്രാർത്ഥിക്കുവാൻ ദൈവ നാമത്തിൽ അപേക്ഷിക്കുന്നു.

A 46-year-old pastor was murdered inside his home-cum-church at Gandhi Camp of Batala in broad daylight on Thursday morning, triggering panic in the area.
The victim, identified as Balwinder Paul, alias Laddi, was reportedly alone at his residence when two unidentified men allegedly entered the premises around 9.30am and attacked him with a sharp-edged metal-cutting tool. He suffered a severe throat injury in the assault.
Family members and neighbours rushed Paul to the Batala civil hospital, where doctors declared him dead on arrival.
Paul lived alone and operated a church from his residence, where members of the Christian community regularly gathered for prayers.
His brother, Mohinderpal, said Paul had no known personal rivalry or enmity with anyone.
Following the incident, a police team led by the Civil Lines station house officer reached the hospital and the crime scene. Investigators examined the premises and began collecting evidence, while CCTV footage from the surrounding area was taken up for analysis.
Police have registered a murder case and are questioning witnesses as part of the investigation. A local resident, Naresh Kumar, named as a suspect based on preliminary statements provided by the family, has been booked under murder charges and a hunt has been launched to nab him.
The victim’s body has been sent for postmortem examination. The motive behind the killing remains unclear and police said several leads are being pursued to apprehend the assailants.

പ്രവാസി ക്ഷേമനിധി പെൻഷൻ മുടങ്ങിക്കിടക്കുന്നതുമായി ബന്ധപ്പെട്ട പ്രശ്നങ്ങൾ, പെൻഷൻ ലഭിക്കുന്നതിലെ കാലതാമസം, ക്ഷേമനിധി അംഗത്വത്തിനുള്ള അപേക്ഷകൾ സമയബദ്ധമായി തീർപ്പാക്കാത്തത് തുടങ്ങിയ വിഷയങ്ങളുമായി ബന്ധപ്പെട്ട പരാതികൾ വിവിധ പ്രവാസി സംഘടനാ പ്രതിനിധികൾ യോഗത്തിൽ ഉന്നയിച്ചു. നോർക്ക സാന്ത്വനം പദ്ധതിവഴി നിലവിൽ നൽകിവരുന്ന 50,000 രൂപയുടെ ചികിത്സാസഹായം വർധിപ്പിക്കണമെന്നും ചികിത്സാസഹായവും മരണാനന്തര സഹായധനവും സമയബദ്ധമായി അനുവദിക്കണമെന്നും പ്രവാസി സംഘടനാ പ്രതിനിധികൾ ആവശ്യപ്പെട്ടു.
പ്രവാസി ക്ഷേമനിധിയിൽ അംഗമാകുന്നതിനുള്ള പ്രായപരിധി 70 വയസ്സായി ഉയർത്തണമെന്നും നാട്ടിൽ തിരിച്ചെത്തുന്ന പ്രവാസികൾക്ക് സംരംഭങ്ങൾ ആരംഭിക്കുന്നതിന് സഹായധനം നൽകണമെന്നും വിവിധ കാരണങ്ങളാൽ ആനുകൂല്യങ്ങൾ നിഷേധിക്കപ്പെടുന്ന സാഹചര്യത്തിൽ അവ ലഭ്യമാക്കുന്നതിനുള്ള വ്യവസ്ഥകളിൽ ആവശ്യമായ മാറ്റങ്ങൾ വരുത്തണമെന്നും യോഗത്തിൽ ആവശ്യമുയർന്നു.

The Kerala Assembly Committee on the Welfare of Non-Resident Keralites will take measures to help ordinary people quickly contact Indian embassies, committee members have said.
The committee, chaired by Parakkal Abdulla, MLA, held a sitting in Kozhikode on Tuesday (October 6) to discuss various issues faced by expatriates in the district, benefits due to them from the government and complaints related to welfare pensions.
MLAs K.M. Abhijith, Pazhakulam Madhu, Mohammed Muhsin, M. Vincent, and Xavier Chittilappilly attended the meeting.
A meeting of the Legislative Assembly Committee on the Welfare of Non-Resident Keralites (NRKs) has decided to set up a system to enable ordinary people to contact Indian embassies quickly.
Collector M S Madhavikutty informed the committee that measures will be taken to swiftly dispose of applications related to Aadhaar cards, electoral identity cards and similar documents during the short periods when NRIs visit home on vacation.
Representatives from various NRI organisations raised complaints at the meeting regarding issues such as suspended Pravasi Welfare Fund pension payments, delays in receiving pensions and the non-time-bound processing of applications for welfare fund membership.
In the meeting, representatives of various expatriate organizations raised grievances related to issues related to non-payment of expatriate welfare fund pension, delay in receiving pension and non-settlement of applications for welfare fund membership in a time-bound manner. The representatives of the expatriate organizations demanded an increase in the existing medical assistance of Rs 50,000 under the Norka Santhanam scheme and timely release of medical assistance and post-mortem assistance.
It was demanded in the meeting that the age limit for becoming a member of the Non-Resident Welfare Fund should be increased to 70 years, assistance should be provided to expatriates returning home to start enterprises and necessary changes should be made in the conditions for providing benefits in case they are denied due to various reasons.
