Indian state’s university teacher quota law wins praise

Church leaders have hailed new legislation introducing job quotas for teachers from marginalized groups at public universities in India’s predominantly tribal eastern state of Odisha.

“The progressive law opens long-denied job opportunities for marginalized communities to participate as educators, researchers, and thought leaders in public universities,” Father Dibakar Parichha, Chancellor of the Archdiocese of Cuttack Bhubaneswar in Odisha, told UCA News on April 19.

The Odisha State Public Universities (Reservation in Teachers’ Cadre) Act 2026 came into effect after it was signed by Governor Hari Babu Kambhampati as the constitutional head of the state representing the federal government, on April 13.

The legislation was earlier passed by the State Assembly on March 31.

Parichha said this reform was important, as it moves beyond student-level inclusion to reshape the very structure of knowledge production.

“At its core, it affirms human dignity and equity — recognizing that marginalized communities are not merely beneficiaries of welfare, but equal contributors to knowledge, culture, and academic excellence,” Parichha noted.

Odisha state has a significant marginalized population, with tribal communities forming over 22 percent, Dalits or formerly untouchable people around 17 percent, and socially and economically backward classes about 40 percent of the state’s 42 million people, according to the last census held in 2011.

Odisha Higher Education Minister Suryabanshi Suraj called the legislation a landmark initiative, paving the way for greater representation of the poor and marginalized, mainly the 62 distinct tribal communities in the state — the highest in the South Asian country.

“The reservation will ensure their direct recruitment into faculty positions, including as professors, associate professors, and assistant professors, ensuring equitable representation of marginalized communities across universities in the state.”

As of 2026, there are 24 public state universities in Odisha, the minister noted.

Bishop Pallab Lima of the ecumenical United Believers Council Network of India said that “while the new reservation policy aims to fix representation gaps, its success will depend entirely on the transparency of the recruitment process.”

The prelate based in Odisha told UCA News that the government must now expedite recruitment to fill over 1,300 vacant teaching posts in the state universities.

“Representation is a start, but sustained investment in infrastructure and academic freedom will be what ultimately defines the success of this reform,” Lima noted while adding that the focus must remain on “quality and research-oriented education” as promised by the government.

The Church leaders felt that the appointment of individuals from historically excluded communities would enrich the academic environment in the state.

“When students see teachers from their own communities, it nurtures a sense of belonging, confidence, and aspiration,” Parichha said.

This could inspire many first-generation learners to envision futures within academia, especially in tribal-majority areas like Mayurbhanj and Kandhamal, which also have a higher concentration of tribal Christians.

“If implemented with sincerity and institutional commitment, it can become a powerful instrument of social justice and human dignity in Odisha’s higher education system,” he noted.

Christians make up 2.77 percent of the state’s 42 million people, over 90 percent of whom are Hindus and indigenous people.

Indian court says Christian woman can file for divorce where she lives

Church leaders have welcomed a ruling by a provincial top court in southern India allowing a Christian woman to seek dissolution of her marriage in a family court where she currently resides after moving out of her matrimonial home.

The Kerala High Court’s Aug. 19 ruling came on an appeal filed by a Christian woman seeking legal separation from her husband due to domestic violence.

The woman, who resides at her parental home in Kerala state’s Wayanad district, had challenged a family court order directing her to file her application in Kasargod district, where her estranged husband and his family live.

The British-era Indian Divorce Act of 1869, which governs judicial separation and marriage dissolution, among other things, for Christians in India, makes it mandatory for women to approach a family court in the place where “the marriage was solemnized, or the husband and wife reside or last resided together.”

In her appeal to the High Court, the Christian woman argued that this restriction resulted “in serious prejudice to Christian women who intend to file for divorce.”

The woman had earlier challenged the family court order before a single bench of the Kerala High Court on the grounds that she was not in a position “to travel long distances, in protracted litigations in a hostile jurisdiction.”

She pointed out that women were allowed to approach family courts where they resided under the Hindu Marriage Act, 1955, as well as the Special Marriage Act, 1954, which enables marriages between individuals of any religion, caste, or nationality, but not under the law governing Christian marriages.

The single-judge bench, in a June 30 ruling, agreed with her contentions but refused to grant her relief, holding that amending the law was the only solution and leaving it to the Indian Parliament to decide.

The judge, however, directed that the order be sent to the federal government, recommending it to amend the 1869 law.

The High Court’s division bench of Justices A K Jayasankaran Nambiar and Preeta A K, whom she approached later, allowed her appeal.

It ruled that she could file her application before a family court “having jurisdiction over the place where she is currently residing, even if that place is different from where the marriage was solemnized or where the couple last lived together.”

Church leaders hailed this Aug. 19 ruling as a “landmark decision” based on “a wise interpretation of a contentious clause.”

Father Ebigin Arackal, secretary to the Commission for Canon Law of the Kerala Region Latin Catholic Bishops’ Council, said, “We are glad that the top court, through its wise interpretation of a contentious clause, has ended decades-old discrimination against Christian women.”

Aleykutty P T, a lawyer in Kerala’s Idukki district, said Christian women were often forced to travel to places where their husbands were based, which made them insecure and sometimes even posed a threat to their lives.

“Now with this order, they can obviously choose a place where it’s safer and they get support,” she told UCA News on Aug. 20.

Govind Yadav, a lawyer at the Supreme Court in New Delhi, said this order for Kerala can become a precedent for other states to follow.

“But as long as the federal government fails to amend the colonial-era law, this discrimination against Christian women will continue,” he added.

Christians make up 2.3 percent of India’s more than 1.4 billion people; about 80 percent of whom are Hindus.
