The Trump administration is considering ending a work-permit programme that has allowed eligible spouses of H-1B visa holders to build careers and earn an income in the US for more than a decade, a move that could have a particularly sharp impact on Indian families.

The Department of Homeland Security (DHS) has placed a proposal to remove certain H-4 dependent spouses from the pool of people eligible to seek employment authorisation on its long-term regulatory agenda. The proposal, listed under RIN 1615-AD14, seeks to reverse the 2015 rule that created the H-4 Employment Authorisation Document (EAD) pathway.

The regulatory entry does not, however, mean that H-4 spouses are losing their jobs or work permits now.

For thousands of families, the immediate question is what would happen to the spouse who currently works in the US on an H-4 EAD, and whether a future rule would allow existing permits to remain valid until expiry.

The DHS proposal is titled “Removing H-4 Dependent Spouses From the Classes of Noncitizens Eligible for Employment Authorization”.

According to the official entry on Reginfo.gov, DHS wants to remove “certain H-4 dependent spouses of H-1B nonimmigrant workers” from the class eligible to request employment authorisation under the C26 category.

As per the department, the proposal would reverse the changes introduced by the 2015 final rule and restore its earlier position of not making H-4 dependent spouses eligible for employment authorisation.

The proposal is currently classified as a long-term action, and the timetable for publishing a Notice of Proposed Rulemaking (NPRM) is listed as “To Be Determined”. No Federal Register notice has yet been issued for the proposal.

Why H-4 spouses could be affected

An H-4 visa is issued to the spouse or dependent child of an H-1B nonimmigrant worker. H-4 status allows family members to accompany the H-1B worker and live in the US, but it does not by itself provide employment rights.

The ability of certain H-4 spouses to work came through a DHS rule rolled out in 2015.

Under the existing framework, eligible spouses can apply for an EAD if their H-1B spouse is sufficiently far along in the employment-based green-card process. This includes situations where the H-1B worker has an approved employment-based immigrant petition, or has received an extension of H-1B status beyond the normal six-year limit because the green-card process is delayed.

The EAD effectively gives an eligible H-4 spouse the ability to take up employment, change employers and earn an independent income.

Without that employment authorisation, an H-4 spouse generally cannot simply take a job in the US.

Indian families could face a disproportionate impact

The impact on Indians is significant because Indian nationals account for a large majority of H-1B beneficiaries.

According to US Citizenship and Immigration Services data, 71% of H-1B petitions approved in fiscal 2024 were for beneficiaries born in India. China was a distant second at about 12%.

The demographic profile of H-4 EAD recipients has also been heavily skewed towards Indians and women.

USCIS data covering H-4 employment-authorisation applications showed a large concentration of approvals among applicants born in India. Earlier data covering the programme’s initial years found that about 93% of approved initial H-4 EAD applications were for Indian nationals.

A Congressional Research Service analysis cited in reporting on the issue found that of roughly 126,853 H-4 EAD applications approved between 2014 and 2017, 93% were for Indian nationals and 94% were for women.

That makes the proposed rollback particularly consequential for Indian women who have built careers in the US while their spouses remain tied to H-1B employment and wait for permanent residency.

Why the green-card backlog matters

The H-4 EAD programme was introduced against the backdrop of lengthy employment-based green-card waits.

For many H-1B workers, particularly Indian professionals, the route from temporary employment to permanent residency can stretch for years. The H-4 EAD allowed eligible spouses to work during that period rather than remain dependent on a single household income.

When introducing the 2015 rule, the DHS had acknowledged that allowing eligible H-4 spouses to work could help H-1B workers remain in the US while pursuing permanent residency and reduce workforce disruption for American employers.

Ending the programme could, therefore, have consequences beyond individual spouses. Families could face the loss of a second income, while professionals who have established careers in the US could be forced to reconsider their employment and immigration plans.

Existing H-4 EADs are not being cancelled now

For current H-4 EAD holders, the most important point is that nothing changes immediately.

The DHS entry on the regulatory agenda does not cancel existing employment authorisation, terminate current EADs or prohibit eligible H-4 spouses from working.

Before the policy could actually change, DHS would have to publish a formal NPRM in the Federal Register. That would be followed by a public-comment period, review of the comments and the issuance of a final rule.

Only after a final rule is issued and an effective date is established could the government implement a change.

The current regulatory entry also does not say how existing EADs, pending applications or renewals would be treated. Those details would have to emerge in the proposed rule.

What could happen to current EAD holders?

The regulatory entry does not specify whether existing EAD holders would be allowed to continue working until their documents expire, whether renewals would be permitted, or whether there would be a transition period.

Similarly, it also does not yet spell out what would happen to applications that are pending when a final rule takes effect.

Those issues would normally be addressed in the actual proposed rule and, eventually, the final regulation.

For now, H-4 EAD holders remain governed by the existing rules and should continue to follow the period and renewal requirements applicable to their documents.

Notably, the administration has previously tried to eliminate H-4 employment authorisation.

During Trump’s first term, DHS placed a proposal to rescind H-4 EAD eligibility on the regulatory agenda and moved it through the rulemaking process. The earlier effort was eventually withdrawn in January 2021 without taking effect.

The current proposal is, therefore, a revival of an earlier policy push rather than the first attempt to dismantle the H-4 EAD system.
